Autoquake again...

I bought a car from Autoquake less than nine months ago and developed a major fault two weeks ago and have been getting the run around - took out a warranty as well and was told they are bust - and would be called back by a MCR case worker???? not happened yet and probably never will - strange how they are still taking the money out my account though for the warranty fee when i was told only this morning that there was no money in the pot too repair any customers vehicles with outstanding warranty claims.

What are my rights now as a consumer with Car that is not fit for purpose and clearly miss sold a warranty that is supposed to cover the repairs.. th i might as well wipe my Bum with it.....:mad:

  • Thanks for the info much more helpful than Autoquake who had the cheek to put the phone down on me - cant see me being able to give the car back though and claiming my deposit back or claiming the past nine months warranty fees either - would have been nice to have been informed by Autoquake as to what was going on?????

    I don't think I've ever heard of a company saying "please don't order from us because we think we might be going bust soon."

    Anything in the other Autoquake thread that might help you?

    I got a sports car from them a year ago. Took out a three year warranty and roadside assistance plan. Never used the service until yesterday car would not start, Rang up for roadside assistance only to be told its no longer valid as carcareplan/Autoquake has gone in to adminsitration _pale_.I asked about my warrenty for the next two years said he cant comment on that ((.


    He informed me that a letter will be sent out to all concerned with infrormation about how to claim this money back.Also said that he thinks that i will recive a refund on this.I belive that when it happens.:A


    Suppose its going to tell me to write to the administrators who are MCR.On the plus side was just a dead battery in the car , got a jump and enjoyed the sunshine ))):)
  • I would like to be able too enjoy the Sunshine in my car thats why i bought a convertible - but as the Roof has a Major malfunction IE the roof wont work and is obviously a major flaw with the car, I would say it is unfit for purpose and was sold the extended Warranty by the dealer as a insurance policy specifically against something like this happening with the roof and other major components of the car, i would think it only reasonable too expect it to be repaired by Autoquake or to get my money back on the car and extended Warranty/ roadside assistance policy........ as i said the car is unfit for purpose and i bet they will carry on taking the money from my account each month for the car and the warranty plan that supposedly no longer exists.....

    Yes its a nightmare and your looking at a big bill for the roof.
    I had alook around for some other quotes for a warrenty for my car.And they were unreal ie 100 pound a month :(.I have my first service and MOT coming up since i bought the car , so i to may find my self stuck with bills and a warrenty thats worthless.

    I would not have got the car with out the warrenty , thats what made the deal.Now its gone.Lets hope for a rival to take over there buisness and houner these warrentys otherwise we will prob get a penny in the pound from the creditors.

    Cant you just stop the direct debit for your warrenty ? i paid for mine via a loan from another company so i dont have that option.

    Yes its true i have never heard of a company doing this to future customers - but i do however expect a reasonable level of customer service to existing customers and would have expected to have been informed by Autoquake that the Extended warranty policy was no longer valid or have been informed of any changes to the policy??? as it is a form of a contract which they are in breech of for whatever reason and why are thay still collecting the Payments - but also saying there are no funds for the repairs for new or any outstanding claims when they are still receiving a revenue from the policy's and car payments???????

    Personal loan/credit agreement arranged by the retailer:
    In this type of agreement, both the retailer and the finance company could be liable if goods are faulty. Your claim against the retailer would be under the Sale of Goods Act 1979 (as amended) or the Sale and Supply of Goods to Consumers Regulations 2002. You could also have a claim against the finance company under Section 75 of the Consumer Credit Act 1974 (as amended), if you can prove that the retailer is in breach of contract or has misrepresented the goods to you.
    Your letter of complaint should be sent to both parties. This equal liability only applies if the cash price of the goods is more than £100. In the event of a legal claim, you could sue the retailer, the finance company or them both jointly.

    Hi,

    I bought a car from Autoquake on the 12th March, not that it matters anymore, but the experience at the time was OK!!

    Basically, I bought the car using finance which was organised by Autoquake (through Santander).

    I agreed to take out a 12 month warranty at a cost of £449.00 which was added to the loan.

    I paid a 10% deposit using my Visa Debit card.

    As with other people, I have now received a letter from MCR stating that Autoquake are in administration and that they are unable to honour the warranty.

    I have phoned my Debit Card provider but I am not too hopeful that I will get anything back from that side, however, I was intrigued by the post from unholyangel above, and I was wondering if this would be relevant to me and how I would approach the subject with Santander?

    Now, my other concern is that Autoquake went into administration 3 and a bit working days after I was sold this warranty/collected the car. Forgive me if I am wrong, but I would imagine that placing a company into administration requires some forethought and therefore, the company should have ceased to offer warranties that they knew could not be honoured.

    If I was aware what was going on, I would have returned the car under the 7 day no quibble return period as it does have quite high mileage and the 12 month warranty I took out was to act as a buffer incase anything serious goes wrong within the first year, I will be financially better of after this period, so the warranty after this period was not as important.

    First post....

    I'm a little worried as I have a car with autoquake which I purchased in Nov 2010, paid for half and the other half has been financed for 3 years. Also have the warranty!

    I can't seem to get through to them right now to see what's going on but can anybody offer advice re the finance?
