    Im worried as well

    I purchased from AQ in October 2010. I didnt take out finance as I arranged my own personal loan with Tesco Personal Finance. I got the letter to say the warranty is not being honoured. My big worry is when I purchased the car I did a hpi check and it came up with outstanding finance. (Unit Stocking). I was told by the hpi company as long I got a letter from AQ confirming the finance will be paid off. I will be ok to purchase the car.
    AQ were happy to supply this to me. My worry now is did they actually pay off the finance on my car after I purchased it. I purchased the extended warranty as well. :(

    I purchased the car and warranty using my credit card and then settled the balance using the loan I got when that got paid to me. I take it my first port of call is the credit card company?

    Just phoned First Direct and they told me contact the Administrators to get the money back for my warranty. If they cant help. I will need to ring First Direct again to claim my cash back. Is this correct?

    Do you have a copy of the finance agreement? What type of finance agreement does it say it is?

    If you read the page i provided from trading standards, it covers different types of agreements and tells you what protection you may have depending on which agreement type you have.

    Thanks for your response. Im gonna double check with the leasing company thats on my HPI check that AQ actually paid it. They are closed over the weekend so this will have to wait until Monday. If they didnt. I got an letter from AQ clearly stating they will pay off the outstanding finance after a few days from purchase. If they didnt. Im assuming I can claim the full cost plus additional costs as well from First Direct?

    As yet, I have received no 'Loan Agreement' from Santander only a documnent highlighting 'Pre-Contract Credit Information' which I left Autoquake with. I have spoken to Santander just before posting on here, just to ensure that I am in a credit agreement with them, which apparently I am.

    However, I did not mention the £449.00 warranty fee to them as at this time i did not know that they had any responsibility over this.

    Reading through this 'Pre-Contract' it would appear that I have 15 days from receiving the executed agreement from them (whatever this is, I did sign some forms at Autoquake but I DO NOT have a loan agreement) to cancel the agreement, now that would be interesting as Autoquake gave me 7 days to cancel!!

    If the 15 days is from when I signed this period expires tomorrow.

    The last few pages state the following at the top 'TERMS OF CONDITIONAL SALE AGREEMENT REGULATED BY THE CONSUMER CREDIT ACT 1974'.

  • At the Moment i am unsure what to do or where to turn to now, I received the Letter from MCR this Morning and still have not been called by the Case worker either - don't know now who i should be approaching to get the repairs done????? do i wait to see if i am offered anything by MCR or do i Approach the Finance company Directly as they supposedly own the Car and state section 75 - are there any template letters that i could use from this Site and how do i go about reclaiming the Money back on the Extended Warranty etc - I paid £1500 upfront when i bought the car with Visa debit card, and Autoquake sourced the the Finance - ive been paying one monthly payment for the car and warranty as a single payment from my back account for both - and need to stop any future payments into this warranty policy without it affecting the car payments - i have been realy happy with the car until two weeks ago when the roof stopped working and just want the repairs sorted.....

    It looks like we are both in a similar situation with the warranty included with the Autoquake sourced finance, I am, however, fortunate enough to still have a working vehicle, as should be expected considering I have only had it for 2 weeks.

    The small amount of loan paperwork that I posess, indicates that I have a 'Conditional Loan' which in reality seems to mean that I have no redress whatsoever under s75 or anything else for that matter.

    Is this the case with you?

    The letter I received from MCR stated that, Quote: "The Company is currently unable to make any payment or provide any benefit in kind to you or any other customer of the Company with regard to the warranty."

    I do not even know who legally owns "my car" at the moment. I don't even have the V5 yet, I phoned the DVLA today, they have not received the V5 transfer paperwork from Autoquake. Santander seem to be under the impression that as the loan is secured on the vehicle, it is technically theirs!! Now, supposing Autoquake have sold the vehicle on behalf of a lease company, but not paid the said lease company, would the car still belong to the original owner and not Santander?

  • Bought 2 Citroens from Autoquake in January and February, both were massively under the price of a similar car advertised anywhere else at the same time. paid in full for both, no finance and didn't take out any warranty, which they were obviously not happy about. Clearly they were punting the cars out at crazy low prices, hoping to get back the lost profit in finance and warranty. No problems with either car, both in great condition with no faults or problems. Lucky escape I guess . . .
