    OK they know your name but can they prove you accepted their offer of a contract and that the money demanded isn't an unfair penalty? I suspect not.

    If the letters you received were anything like mine they've already shot themselves in the foot - threats of CCJ's, Bailiffs etc to someone living in Scotland are big no, no's if I understand correctly.

    Does anyone know on what basis this case was won ?

    I'd be very surprised if it was as stated by the case winner on CAG "the main decider was that I didn't see any of the sign in the car park so therefore there was no acceptance of contract!"

    Unless of course the signs were so small or so badly placed as to make them unfair ...simply not seeing the sign has been tried before in cases and as far as I am aware it is not usually sufficient to win on it's own.

    Anyone able to shed any light on the exact reason(s) this was won ?

    Perhaps Firebird 20 would care to enlighten us ( but there again probably not :-) )

    I have come in at the tail end of all this and it seems good news all round. Does this mean that the fact that no signs were visible or big enough or whatever, to accept the contract, would be applicable to council run, via NCP, multi storey car parks would be governed by this?

    I am disabled and fighting a ticket, I will post a thread soon, but if this is true, I will write a letter today? :j

    I do not have such luck, but I would appreciate any comments?

    In fact would this apply to any parking ticket out of any machine? If the T&Cs are not clearly signposted, you cannot form the contract and thus it cannot be enforced?

    In short, unless it's a ticket from the COUNCIL, then ignore it. So let us know where you parked and who issued the ticket :)

    Thank you, I will do that, when I can get my computer to work properly to upload my photos etc, watch this space? In short, it is a council ticket though, so that sounds ominous, but in a multi storey and according to my blue badge scheme rule book, the scheme does not operate in off road car parks. I parked, paid £9.60 for the pleasure and got a tcket because my badge, firstly was not displayed correctly, squint slightly obscured (which I believe is on the PCN), then after I appealed, they checked up & it was out of date, which I knew so wouldn't have used it on the road, so they are saying now it is not a correctly displayed "valid" badge; but given that I didn't think it applied there, I only put it there to indicate my disabled status, not as a legal requirement as one would on the highway, because I knew it wasn't valid. Having said that, the sign said disabled badge holders, not "valid" badge holders!?

    I will post as soon as I can, that will be after I get over the rage for having been given a parking ticket today, because my ticket fell off the windscreen onto the floor. I caught the chap sticking it to the screen so I opened the car and retrieved the ticket off the floor where it had dropped (it was damp and cold so didn't stick well) and showed it to him, he said too late there is nothing I can do I have issued it now, you will have to write in and appeal! I'll add that to the one I recieved in an off road council car park, where I have a disc entitling me to two hours free parking, where I received a ticket for not being exactly in the white bay (car next door was squint so I had to be squint and didnt want a bashed door if they couldnt get into their car) I am doing well! & they say there is not such thing as bad luck! Lol!

    Could you please start your own thread . This one is about a private parking company called UKCPS. You problem is with a council ticket.
