    This is an issue between the OP and her ex, trying to bring the lender into it is just confusing matters.

    Might not be very PC, but I would suggest the OP gets her current partner to go and "have a word" with the ex and come to an arrangement.
  • Erm...you're screwed. A joint loan means just that...a joint loan. It's not the fault of the loan company and FOS that you signed up to a joint loan with someone who later decided to do a runner. Some people find it hard to blame themselves.

    Maybe what you should of done if you were being threatened to sign, is ring the loan company and tell them before it got processed.
    But i also don't think there's much you can do now. I think you've been offered some good advice in going to a domestic violence charity.

    Nooo, Crazyguy, you have let me down :-)

    I haven't let the company know where he lives as I don't know myself and upon giving a previous address they were not interested, I do not have authority to provide them with his address apparently.

    This is a living hell, I've had an awful week and don't know how much more I can take quite frankly. I'm seriously considering BR now, but it's such an extreme option. I don't qualify for an iva. The loan is now with a debt collection agency. CCCS worried me yesterday by saying that if they issue a CCJ and if dirtbag ex has no income I will be ordered to pay it all. He has assets in the region of 40k to my knowledge which could be sold so why isn't he forced to do so!!? This is so wrong!! Rant overwith.

    I think it may be worth while trying to get his address and telling the debt collectors that it is a jointly applied loan and you are only willing to pay half back, It may be worth a try.

    And as for saying that you cannot give his details well its a joint loan so in theory you have the right the disclose his address to them to chase him for half the amount.

    I do hope you get things sorted out soon !

    I know whereabouts he is but don't know an address but do know who he is living with. Do these agencies trace people? Thing is I am loathed to pay half also. I am going to write to these people and explain all this, what has happened, the assets he has and equity in his home which he rents out, and the fact that I have massive debts and no equity, surely they will take notice of this. His website is there for all to see he can't hide that.

    In times of desperation like this I think anything is worth a go to be honest, I would at least send them a letter guiding them to him and state the facts and the fact that he entirely benifited from the loan and you gained nothing from it after all what are they going to reply with either yes we can attempt to recoup 50% from him or no we cannot.

    I would give it a shot, failing that maybe go back to the police and state that you were threatened to take this out and require some help from them to intervene and help get this crap situation resolved, again could be worth a try.

    Cant think of anything else at the mo.

    It doesn't matter what the OP is willing to pay back - she signed the loan and is jointly liable to pay it back. The loan company has the right to chase either party for the entire amount. That's what the OP legally agreed to when she signed.

    The ins and outs of the relationship do not change this fact. I know it's not what the OP wants to hear, but that's the legal reality of it.

    Now the last post from the OP about showing the bank she has no assets and no way to pay it back is a good idea. If you can show them that you have nothing and that the ex partner has assets and can pay it back, they might focus on chasing him for the money instead. You will need proof though, not just hearsay.

    There is some good advice for you on this thread - about contacting debt charities who will help you find a way forward with no charge for their services.

    I know you came here looking for advice on how to get out of repaying the loan, but I'm afraid that legally there is no recourse for that. I know it's not the advice you wanted to hear but the best thing you can do now is to focus on how you deal with the debt going forward or how you can get them to pursue your ex as well as yourself. Wasting time and energy trying to prove to the loan company or the police that you didn't benefit from the loan will get you nowhere. None of the circumstances change the fact that you signed for the loan and are legally responsible for it. There is nothing the police or the loan company can do to change that. You're better off focusing your efforts on what you can deal with.

    I know it's frustrating and I know you're in a horrible situation. But much better to focus on how you can change it rather than wasting efforts and energy on things that will have no impact.
