    With what? A new one?

I am prepared to purchase a second hand dishwasher but surely a new for old doesn't apply here.

What is my position legally regarding this?

I suppose the legal position is did you tell them it was working?

Put it this way, if you (OP) bought a house and when you moved in, found that an appliance was not working would it not take the shine off the moment somewhat?

Frankly, if that sort of minor thing would upset you, then it's likely that the sort of house involved would be a modern, boring box. All the houses I've owned have had interesting quirks, like lethal gas appliances, or strange men who arrive to inspect the sewers and expect to eat sandwiches on the seat in the garden, because 'they always do this.'

Since moving in here, apart from the non-functional oven, we've discovered a telegraph pole erected in 2006, apparently without permission, as Openreach thought the land belonged to someone else, an outflow from a septic tank installed at some time, again without any paperwork, and two horses buried (100m from the house!) in 2006 and not dealt with by the council until 2010..... "We've come to inspect your horse burials." (They're a bit slow around here!:rotfl:)

On the plus side, nobody told us Western Power would send us £50 a year, or that a huge newish freezer in the garage, a Sky box and an electric fencing unit would stay.

You win some and you lose some. :)

It looks like a seized pump so the cost of that and someone to do it obviously isn't worth it.

Are you sure it is seized? Most times you open it up and it is just a piece of food waste stuck in the impeller. Clean it out and carry on.

The pump at the bottom that drains away the water is working fine.

I think its the circulating pump that starts at the beginning of the cycle.

    The machine just buzzes.

I'd ask them (via EA or solicitor, or direct if you have their no) if they want it replacing with a second hand one, seeing as that's what they were buying - but I'd definitely get it fitted for them. If as someone's suggested they're replacing the kitchen, I'd leave them the money - £50 or a bit less?

They're buying a house with a working dishwasher - you're obliged to sell them a house with a working dishwasher. If they choose for one not to be refitted, that's up to them and they can let you know.

If I were buying from you, I'd choose for a s/h one to be fitted - or I'd agree a price for a s/h one, make up the difference myself for a new one, and would hope you'd arrange for it to be fitted. I'd not really want to have to buy or fit one myself.

Legally they are not, unless the OP has actually confirmed, either verbally or in writing, that it works.

    Morally, however...

I don't know the legal position, but if I was buying any property other than a new build, I would not be surprised to find that an appliance didn't work. It could have broken down on the day before completion and I would not expect the seller to replace it or even compensate me for it.
  • Just ask via solicitor like someone suggested above. If it was me I'd rather know it was kaputt and dust off the old marigolds rather than getting a surprise!
