    If you have he money, why not just ring the apple store and tell them you want to pay cash instead of this agreement? If the agreement waOK, they would have taken the money. THey may have not got all the signatures they need, so it may well be you have signed the credit agreement, but not the DD mandate, so you have agreed to repay, but they can't take the money. Have you checked your credit report to see if it shows? It could be showing as a late payment already.

    Have you had any literature in the post about it?

    Best option is to sign, send back and get paying, or to speak to barclays/apple and settle now so it is out of the way when you are sorting out your mortgage.

    Possibly, possibly not.

    Even if the agreement is not binding, that does not mean that you don't owe Apple the money for the laptop - it just means that you don't owe the money to the finance company.
    Incidentally, the CEO's and top level management of both Apple and Barclays take home ENORMOUS end of year bonuses whilst everyone else suffers.

    I'm not sure why you are bringing this up; it's completely irrelevant to the matter at hand.

    Probably not.

    However, the mere fact that they cannot enforce the agreement does not in itself mean that you do not have to pay for the laptop - you will still owe the money to Apple or the reseller and they can still take legal action against you to recover the debt.

    Actually, that may well be true for nearly all laptops *except* Apple ones.

    Apple hardware holds it's value extremely well and does not depreciate at anywhere near the same rate as other brands.

    But don't take my word for it - take a look at the listings on eBay yourself.

    I may be wrong but your debt isnt with apple its with the finance company. Apple have sold it to you and the finance company has paid for it. So if something wasnt signed correctly then the finance company wont pay apple and that makes the transaction null and void. Clutching at straws but would it not then become a 'gift'. Apple need to claim the money from finance company and finance company from you, seeing has to never signed to this agreement I don't see how they can enforce it.

    I can only add to the weight of correct advice. Whether an agreement has been signed or not is irrelevant if one party has fulfilled their part of the contract. The specific terms of that agreement are no longer binding but if someone provides goods or services to a willing buyer then they are entitled to payment for it.

    What might be interesting is if Apple were not paid anything by Barclays. If not, then arguably you could just settle the debt with Apple. But you didn't agree to lease the laptop for three months, you agreed to buy it. So Apple would be within their rights to claim the money from you.

    If you don't want the laptop, just sell it on eBay.

    To me it looks like apple have not yet been paid, because it is them who called and said they would send me back the agreement to sort out. I could be wrong but maybe Barclays have contacted apple to say the agreement is not right, and apple need to sort it out before barclays pay up... Apple aint doing a very good job at sorting it out though, still nothing has arrived, going to call the store this evening and ask whats going on.
  • Alright maddy13! From wa u said so far I gather the impression tat ur debt is with apple! Obviously the finance company has not paid apple the money due to issues with contract! Also why did u buy a laptop tat was going out of date just couple months after purchase! If I was u I'd refuse to sign! Ur only goin pay finance beginning now on a laptop tat has literally halved in price due to the release of the latest MacBook pro! Ya see all these other people talking bout morals r clowns. It's !!!!! like them tat get this country the way it is! Letting finance companies and shops walk all over them, treat them like !!!! when they have customers signed up in a contract! Some users actually said u should appreciate barclays giving u credit! Wa about their late payments charges [£30] letters to b sent (50) all small print stuff! And b4 anyone says tat u shouldn't take finance if u can't afford, u never know wa happens in ur life, then bang, no consideration and a big charge from finance company! Take ur laptop bk, tell them ur not signing agreement unless they give u the latest model! Stand up for urself and don't listen to any of this negative feedbk!

    Really? I would have thought that someone like yourself who doesn't think that agreements should be honoured is far more likely to have a negative impact on the economy than those of us who abide by the terms and conditions they agreed to.

    If you don't like the way finance companies and banks loan money, then the simple answer is, don't borrow from them!
