    BANG ON 1jim. The old ambiguity trick that the banks / lawyers have been using for years. Put a few grey areas in so nobody has to be accountable. Then they move on to "there is a lesson to be learn't here".

    How is it bloody ambiguous? If they send you the information and you choose not to read it then whose !!!!!!!' fault is it? I've never seen someone who claims to have been "caught out" by "tricks" who simply didn't bother to read what was put in front of them and assumed the contents didn't matter. Lo and behold, you are not an exception.

    MBNA put their payment timescales on the bill. Your payment fell out of those timescales. You got charged because of it. There is no trick, there is you failing to read and follow simple instructions and instead making assumptions about how things work. It's your fault. MBNA have done what they say they will, no more no less. You failed your end of the bargain.

    You may argue that they should process payments immediately, you may argue that they should do so over weekends, you may even have a point, but they never said they would do so, would have advised against it if you asked them and dutifully print information about it on the back of every bill they send you - which you must have at least glanced at, that is unless you also think the bills are there to be ignored too and stick them up your backside instead of reading them, which is in my mind a distinct possibility having read a few of your posts. It was your assumption that led to your predicament. Once again, your fault. Now shut the hell up, learn from your mistake and let this stupid thread die.

    For the sake of clarity, there are two issues here from what I can see:

    1.) Not reading the small print - a common mistake!

    2.) The fact that the faster payment service can only be relied upon IF AND ONLY IF the recipient of the funds accepts this so called 'faster payment' AND the payment can and will be accepted/acknowledged on a 24/7 real time basis by the recipient. Which is clearly not the case for MBNA after 4pm, on weekends and bank holidays, during which the funds will be acknowledged the next WORKING day.

    I think that the term ambiguous can be correctly applied to this faster payment service, which cannot be guaranteed. There appears to be many many people who are unsure whether reliance can be placed on this system when a same day payment is required.

    Perhaps ambiguity is not the correct rationale for a case where someone is simply trying to get out of a late payment on a technicality. When the truth of the matter is that they did not read the small print!

    Although in my opinion, surely there are better things to do in life than spend time questioning the intelligence of someone who clearly suffered a loss, due to a simple misunderstanding of a system which is very confusing and is not standard across the board!

    As for the posts regarding letting the thread die and this apparent obsession by MDD, if it weren't for people responding, there would be no obsession and indeed no thread! So congratulations to all of you for contributing these churlish negative comments, thus continuing the debate and wasting your own time and energy on a concept that you considered to be flawed from the outset!

    On the other hand I would say well done to the people who actually gave constructive advice and opinions, which is what I believe the forum is truly for!

    Please note that this will be my first and only comment on this thread, so feel free to post negative responses, which appears to be the trend for some of you who have nothing better to do with your time!!

    My closing point would be that it would be far more constructive to spend time looking at the facts in cases such as this, instead of insulting someone!
