I Bought an Item, it never turned up...now what??

They were deliberately refusing to refund until RM had completed their enquiries, that would take months. Anyone refusing to follow ebay policies and forcing a buyer to open a dispute for INR deserves a neg.

Royal Mail will not let a claim be made within 30 days of the item being posted (have had this issue myself as a seller) did he get proof of postage, if so ask him to send a copy to you, you can also start a claim with royal mail but he should be doing it really. Does the listing state the method of delivery? Check with your local depot if they have item and postie has not put a card thro, this was what happened in my case the item was posted but the buyer did not get a card and it got returned to me 17 days after it was first posted with a message that the buyer had not collected item.
Unfortunately there are dishonest people out there and if he hasn't got proof he should take the burden of the cost and follow up with royal mail, I would advise you to check locally too with your local sorting office just incase and to say to him that you have done that, that way if he hasn't posted it he may feel guilty and get it posted all of a sudden.....Working to be debt free by September 2014Worked in Travel for 10 years so happy to help with any query!

Poor advice, the buyer need not make any claim with royal mail, that is for the seller. The buyer (the OP) just needs to make a claim with paypal for a full refund as has been mentioned already in this thread.0 -

Kelly you really need to understand ebay rules a bit better, as you are giving incorrect advice here.
It's not the buyer's responsibility to make a claim.
Seller should refund regardless of having proof of posting or not, PoP is only for the benefit of making a claim with RM, not to use to refuse a refund to the buyer. PayPal/ebay only accept online tracking, so it would not even help win a claim.0 -

Many thanks to those who gave such good advice. I got my refund, and the seller has had a form sent to me by RM asking me to complete it so he can claim ( not sure how he goes about that, since he informed me he sent it via normal post! ).
I have asked him if he intends leaving feedback for me, since I had paid within 15 minutes of auction ending...his reply is " I may / may not give you feedback, I won't decide until the RM confirm you've completed and returned the form to their / my satisfaction. Once I have it I'll decide".
Since I had to involve eBay / Paypal to get my money refunded , which they did quickly!, I'm more than concerned he may make detrimental remarks about me , even if he posts the feedback as positive. certainly, everything about his attitude makes me feel he'll be aggressive in any feedback he gives me.
I know he can't give me a negative..... but am I being fair in telling him I won't complete the form ( which has arrived ) and return it, until I have seen my feedback from him? It just seems I'm on the defensive after doing absolutely nothing wrong! I paid straight away...nothing arrived, and I had to chase him via eBay/ Paypal to get my money returned! I've even been to my local sorting office twice to see if was mislaid etc.... to try and help him out.
Admittedly, he's annoyed since the item was expensive ( nearly £60 ) but he charged me a fair whack as postage...then admitted he sent it first class only. He only admitted to this when I asked for the Tracking Number, so I could help chase up via RM.... certainly the postage I paid would easily have covered the cost of Recorded Delivery!!if i had known then what i know now0 -
Call me a big meanie, but i'd be giving this seller a neg, i dont take kindly to people taking my hard earned money and then giving it attitude!
You could fight fire with fire and say you wont fill the form in until you get then positive feedback you want
If he were to give you positive feedback with negative comments you can get it removed by ebay, or leave a reply if you wished.

If he leaves a neg remark you can ask ebay to remove it. Or you could leave it on & add reply to it in such a way that will let anyone who looks at it to see who was at fault.
I wouldn't send an "I'll complete the form, after you've left FB", it could quickly become a "My Father's bigger than yours". It is only feedback.
It's not your fault that he didn't send the parcel correctly.
Whether you complete the form or not is down to you, I would but would be leaving neg FB & low p&p stars, if you feel that he charged for a service that you didn't receive. Comm Stars would be a 1. The other 2 I would leave blank as you have no way of knowing.0 -
