    You say that it goes back to a B&B you were at? Maybe someone with such a similar name did take out the loan, or even someone tried ID fraud with your details and got the name slightly wrong?

    Any paperwork that does come through might help work out what happened?

    Thanks for all your advice. Will wait for the paperwork and see what happens. Will keep you posted and ask for any help if i need it.

    Well, all the paperwork they said that they would send has arrived. Imagine my surprise when I opened it to find that it is just an assignment of debt notice and that the amount owed has doubled since they spoke to me on the seventh.
    Am going to go ahead and send the statute letter, but am wondering how I go about sending it recorded delivery, to ensure that they receive it, when the onkly address that they have given me to reply to is a PO box? Can anybody help??

    I've sent things recorded delivery to PO Boxs in the past had and them signed for by the company when they go to pick up their post, so should be OK.

    Make sure you demand that they remove false data they have put on your credit report as the debt isn't even yours in the first place.

    Recorded delivery at least when sending the SB letter, and make sure you provide no signature to them (or any other DCA, for that matter) at any point. These points can't be emphasised enough.

    I'm not sure of HFO's exact address myself - I'm sure someone will be along shortly to help out on that one.

    Thats ok then, will send it first thing tomorrow. Just cant beleive that they havent sent any of the paperwork, other than the notice of assignment. Will that affect my statute barred letter?

    As said previously, you should adapt the "stock" letter.

    The letter should say.

    1) You deny the debt is yours, and if they disagree your require unequivocal proof that it is.
    2) As the debt is not yours, you demand that they remove any defamatory and libelous information reported to the credit reference agencies in accordance with the Data Protection Act.
    3) Regardless of (1) or (2) it is clear that this debt would be statute barred in any case.

    In some ways the statute barred point is the most minor if it isn't actually your debt, although it is often the one that gets rid of these morons the quickest.

    But you also want rid of the falsely applied info on your credit file, so that needs to be stressed.

    Well, thats it. Letter posted. Now to play the waiting game with them. How long do you reckon before they get back to me with some other excuse
  • Well, that was quick. They have sent through photocopies of all the paperwork and now I am in a bit of a state, as it clearly shows what appears to be my signature!!! Don't know what to do now
