HFO Services

Hi all. Apologies in advance if this sort of post has already been answered but I am new here and have tried to find a similar request in the forum but cant.
At 7.45 tonight, I received a telephone call from HFO Services about a debt they alledge that I took out in 2000. To say that they were a bit bolshy would be an understatement
According to them, and acknowledged by me, I wrote to them in 2009 disputing this default. They assure me that they wrote to me, but at a previous address, not the one that I have lived at for the last 5 years!!.
I politely asked them to cease contacting me by phone and asked for their address as I wanted to re send an official dispute. They just responded by saying that they would send all the paper work to me. They then told me that if I didnt respond within 7 days from now that they would set their solicitors on me. I am aware that their solicitors are owned by the same company, (Turnbull and Rutherford) and am wanting help on waht to do next. As this loan was apparently taken out by me nearly 11 years ago and sold onto them in 2006, with no communication other than my original dispute, am I able to send a statute barred letter, or do I have to wait for their paperwork to show up? If they do send paperwork, does it have to be the original finance agreement? I am nearing my wits end with this one as I dont know what to do. Please help

    You didn't acknowledge the debt in 2009? You disputed it you say?

    If so, then send the statute barred letter.

    Thanks Fermi, will do taht first post tomorrow. Do I need to worry about the fact that they are sending paper work through the post? All I know is that I have never acknowledged this debt, only disputed it. Does the fact that the debt is to a similar surnbame, but one letter different help me in any way?

    So the debt was never yours in the first place?

    Not that I am aware of. I have no recollection of owing the original company any money, or having an agreement with them, nor have I ever received any communication from HFO until tonight. The only reason I have ever disputed this is because it appeared on my credit file while looking for a mortgage in 2006, now it has reappeared on my credit file saying that i defaulted on the account on the day they say they bought it!!!

    So........

    1) It's not yours.
    2) Even if it was it would be statute barred.
    3) HFO have now recorded false defamatory information on your credit report in the form of a default.

    And they are threatening YOU with court? :rotfl::rotfl:

    Not as yet, only a verbal warning that they would pass my information on, if I did not respond in 7 days, to their solicitors and that they were aware that I was in a property with a mortgage in my name

    Yes, there is a default on my credit report in their name as it is linked to a previous address, which was a B&B when I was working away from home!!!

    I thought you meant that they hadn't put a default on. But you were taking about starting legal action. Oops!

    OK. There is a link below to the basis of a letter that.

    1) Denies that you are liable for the debt.
    2) Tells them that it would be statute barred, even if you were liable.

    Obviously, you would need to add in that they are recording a false default on your credit reference file, and that you require that it be removed.

    Thanks for the help. They havent provided me with a reference number, and the loan number isnt available through my credit report, does this mean I have to wait for them to contact me?
