    I appreciate this is an older thread that has just popped back up again, but just to bring another perspective to this; I regularly receive lots of these automated messages confirming I hold products with PPI and how their company can help me reclaim it etc, however, I do not now, nor have I ever, held a product with PPI which makes me think they are just operating a mass market cold calling campaign in the belief that lots of people have PPI and no doubt some people will take up their services

    Should I have PPI I would never use one of these firms. Also, as another poster has commented how on earth would they be able to access all your information and confirm anything.

    Hi

    I also had a call over a year ago, which i paid the £200 and completed the forms etc... Then didn't hear a thing for over a year. During that time i decided to make a claim directly to my bank, as my bank had told me all previous claims had been deregarded and new claims had to be made.

    I then recived my compention for the miss selling of a PPI, but this company [TEXT DELETED BY FORUM TEAM]are now chasing me for 25% of that compention. They are even taking me to court!! The first i heard of this company they call me asking if i had recived thier invoice for their services, to which i hadn;t and i questioned it. They were suppose to send me a documnet i had signed agreeing to their services. To this date i haven;t recived anything from them, just a few agressive voice messages and a court letter.

    Can any one help or offer any advise if this will stand up in court?

    Apart from this almost certainly being a breach of regulations, it may help you. Do you still have this in writing?
    They are even taking me to court!!

    That is quite normal with claims companies dealing with people who refuse to pay.
    Can any one help or offer any advise if this will stand up in court?

    largely it will depend on your contract you completed and your ability to provide evidence that your complaint made [TEXT DELETED BY FORUM TEAM] had been rejected. If the bank did reject it and [TEXT DELETED BY FORUM TEAM] never followed it up and then you started your own process then these need to be treated as two independent complaints and the outcome of the second one does not change the outcome of the first.

    Unfortunatley i don't have it wrting from my bank as it was during a meeting with a financial adviser i was told this. I will try to get hold of him and see what he has to say.

    Since the court letter [TEXT DELETED BY FORUM TEAM] have since sent me some corrospondance between the bank and [TEXT DELETED BY FORUM TEAM] to support their case. Its just annoying it had to go this far, as that is what i asked for in the first instance and they didn't send me anything.

    Hi my mum has recently used [TEXT DELETED BY FORUM TEAM] to re-claim ppi on 3 loans with lloyds tsb. March 2011. She was also told if she paid £200 upfront they would act on her behalf and that a claim could also be made against her mortgage provider (this was the ONLY reason we decided to go with a this company) as we had all the relative paperwork for the loans and could have re-claimed direct, however as my mum had no paperwork relating to her mortgage we trusted [TEXT DELETED BY FORUM TEAM]could retrieve all monies paid in. Fiona also explained she would email her with all the details and a follow up call would be made 2 days later. In the meantime I did check that this company was regulated by the Fsa, which they are. I insisted that she question the fee with Fiona and it was confirmed that NO OTHER CHARGE would by applied and infact if the claim was settled within 12 months then the £200 would be refunded.
    After being informed no money could be claimed off her mortgage we were left with the lloyds claim and this would be settled within 12 weeks. An offer was made to my mum for £5000 on the 23 SEP 2011 which came directly from Lloyds to her home address and the offer was accepted. Today a letter arrived from [TEXT DELETED BY FORUM TEAM] with a bill for £1200 FOR THEIR SERVICES????? THIS IS AN UTTER DISGRACE and I am now dealing with this matter!! PLEASE DO NOT GIVE ANY MONEY TO THIS OR ANY TYPE OF COMPANY.

    The MOJ has published concerns about taking fees up front here.

    This gives grounds for complaint against ambulance chasers.

    Very specifically it says:

    "Whilst you can take a payment or fee from a client before providing the service you must first provide the required information to clients. The purpose of Rule 11 is to enable clients to make an informed choice based on the pre-contract information provided.
    You must not take a payment or fee before this pre-contract information is provided in writing and the prospective client has had reasonable time to consider the information. A reasonable time is not defined, as what might be reasonable for one person would not necessarily be reasonable for another. But we would always consider it unreasonable to provide the information at the point of contact – whether it is a cold call or the prospective client contacted the business – and request a payment or fee."


    Note that last point. If you have been asked to pay a fee at the first point of contact, the MOJ says that is always unreasonable. That puts you into the driving seat because you can say that they have breached Rule 11 and, had they not done so, you would not have used their services. The argument that, having paid you felt stuck with them would seem quite persuasive.


    It also says, "Rule 11 requires you to provide certain information before and therefore before any payment or fee is taken. The information that must be provided is listed in detail in Rule 11, this includes:
    • Information to help the client decide about the risks of claiming, in particular the possible risk of losing money and in the case of potential legal action, appearing in court
    • Information about the service you provide
    • Information about the procedures you will follow
    • Contract documents and how to cancel the contract
    • Any charges you make and any other costs the client may have to pay
    • 14 day cooling off period
    • Any referral fee received by the business
    • Documents you will need
    • Any relationship you might have with a solicitor
    • How the client can complain about you
    • The “regulatory statement”
    • Explicit information about the client’s right to seek further advice and to shop around"

    If any of these have not been explained you (whether or not an up front fee was paid) then, again, you have grounds for complaint and, if necessary, can take the matter to the MOJ. In particular not informing you of the right to shop around is grounds for complaint. (Ironically it is not a complaint you can make against the firm that sold you the PPI in the first place).


    It also says, "Rule 10 of the client specific rules requires a business to do some checks into possible alternative mechanisms for pursuing a claim. This includes checking that a prospective client does not have some legal expenses insurance that might cover the claim or some other form of insurance that might cover the cost of making a claim."

    This means if you have legal expenses insurance available, perhaps through your home insurance policy or possibly employer benefits, you almost certainly have grounds for complaint. You may do if there if you have a local CAB or other voluntary organisation local to you that is able to help or even a legal helpline available to you (even your car insurance may provide that).

    That is not to say that they might not be aggressive but you can still complain to the Ministry of Justice.

    Hi i just wanted to warn you dont use [TEXT DELETED BY FORUM TEAM] reclaim/review.
    They called me about 8 months ago saying any loan i took out and payed ppi on they would claim back for me .
    they first started off by wanting £200 straight away to start the claim off. they said the £200 was to have a membership with them for a yewr .. and that they had other things they could do for me( like look for cheaper elec and gas bills for me ) and (home contents insurance) i told them i dident need any of that.
    that i could find them things myself in 30 mins online..
    anyway 8 months later after filling in i dont know how many forms
    for them.. not to mention about 60 phone calls to them.
    my bank finally agreed to a settlement of £1000.
    do you know what [TEXT DELETED BY FORUM TEAM] wanted from that after already getting £200 out of me .. they wanted another £360 ..
    so for the few forms and couple of phone calls they sent and made
    to my bank for me.. out of the £1000 i got for my claim they made
    £560.... thats more than what i got ...what a joke ..
    they will not tell you this at the start they just string you along .
    and when i told them i thought they were getting to much they said if they dont get there money in 2 weeks they will pass it on to a debt collecter and i will be charged for it..
    ive not even got the money yet and there threntening me ...
    Please make sure and dont use [TEXT DELETED BY FORUM TEAM].

    I recieved an automated call this evening from [TEXT DELETED BY FORUM TEAM] regarding mis sold PPI telling me that i could claim, after pressing the relevant number to connect to an advisor i spoke to a woman called Sophie Ann, she was very nice and polite on the phone although very chatty and very convincing, i must admit i was very intreaged, i did however start thinking to myself, 'whats the catch' and then at the end of the coversation she informed me of a fee to join of £250.00, that was the catch, my husband however was listening on and told me that it sounded very dodgy and to hang up so i did, she tried to ring back so my husband answered the phone and spoke to her telling her of our concerns in which she tried to convince us that she understood where we were coming from and tried to reassure us of a website called 'claimsregulations.gov.uk' saying that they were registered on here, however, i have searched in vain to find this company and cannot find them on here no matter how hard i try, it has given me great doubt in my mind that this company is genuine so therefore i have chosen not to have anything to do with them anymore, but my main worry is can they still take money from my account although i havent given any bank details it still worries me that they have enough information to take the £250.00 fee from my bank, does anyone know, they are meant to be ringing me back tomorrow evening, also they are meant to be sending me the forms!

    If you did not give them your card or bank details they have no other way of taking money from your account.

    If you had ppi and you believe you were mis sold,then all you do is write to the lender with the reasons you think you were mis sold and go to the post office to post it !!!,a claims co cannot do anymore for you than you can do yourself and there wont be a fee to pay at the end.

    When they phone you back,dont get into a conversation with them just tell them you are not interested and hang up,if you get any paperwork from them,bin it !.
  • More than 2 years ago when my husband lost his job we were contacted (I can't remember how) about a company offering to get back the PPI on a loan we had. This was before all the recent stuff and, because we were desperate for cash at the time, we said go ahead. Despite chasing them up infrequently, nothing much has happened over the years except for the odd letter and thankfully my husband got another job.

    Now we have been contacted to say that they can get cash back for us but want to take 25% of the offer! This amounts to about £3,000 - which as you can imagine we could certainly use.

    My question is : are we locked into this, is there any room for negotiation over the fee or can we tell them to get lost and do it ourselves? We only agreed at the time because the mis-selling of PPI wasn't in the news at the time and we feel that the person who recommended it to us knew that we were vulnerable.

    Be grateful for any advice.
