Faulty tomtom

Hi all
I purchased a tomtom rider April 09, it was sent back and replaced November 2009 and again May 2010 as the charging dock on my motorbike became faulty, this is due to wear on 1 pin on the bank of contacts.
It is always the same pin and a friend with the same model has the same problems.
Now I understand it is nearly 2 years since original purchase(10 months old replacement unit) but after paying over £300 for the system it should work for more than 10 months between replacement and over 2 years as a whole.
Would I have any chance of success trying the 'not fit for intended purpose' line since I can pretty much prove inherent fault due to this being the 3rd time with this one and mate is on his second unit now.
Sorting this myself will cost about £60 for a replacement mount plus whatever tomtom want to replace contacts/back case on the unit.
How would I go about this line of complaint?

You would need to obtain proof that the unit was inherently faulty and then present this to the retailer, claiming your rights under the sale of goods act (a repair, exchange or partial refund)0

Why does it say two years and not one on the guarantee information that came with the item and on the tomtom web site?

1) TomTom International B.V. (“TomTom”) warrants to you that the Hardware will be free from defects in
workmanship and materials under normal use (“Defects”) for a period of two (2) years from the date that the
Hardware was first purchased by you (“Warranty Period”). During the Warranty Period the Hardware will be
repaired or replaced at TomTom’s choice (“Limited Warranty”) without charge to you for either parts or labour.
This Limited Warranty covers the replacement of the Hardware only. If the Hardware is repaired after the
Warranty Period has expired, the Warranty Period for the repair will expire six (6) months after the date of repair.
In addition to this I feel that as the rider2 is inherently faulty, since this is the 3rd time this identical fault has arisen for myself plus friends who use these rider 2 units have had the same problem I feel that under the sale of goods act I should be entitled to a repair, exchange or partial refund

Yes, is may be very likely, but it could possibly be that the way you are using the thing.
e.g. maybe the way you connect the things together may not be the best... but you are consistent... hence three identical faults.
Now, I am not saying the thing is not inherently faulty... just that if you need to prove that it is, then an independant report may be needed.
You used the terms "sent it back" and "messaged them".
Who are you dealing with?
Who sold it to you?
Any remedy under the Sale of Goods Act will come from the retailer.
If you want to use the manufacturer's warranty, that is something different, and is in addition to your statutory rights.0 -

Have had a look at post #3, thats why I made my post on bikers forum.
Any replies from them can be followed up on easily.
It is tomtom directly that I am dealing with.
Were very good previously and had a replacement unit within a couple of days but this time want to sell me a new mount.0 -
No, bought from a dealer who was cheapest in uk.
This actual unit came directly from tomtom under the guarantee, don't know if that makes any difference0
