Can I claim back a penalty for a late mortgage payment?
Is it exactly the same process as for bank charges.
I've search the forums buy the only reference to mortgage charges relate to redemption penalties.

Beware: banks and lenders are allowed to charge fees that reflect their costs in dealing with a late payment. You need to be sure that the charge they made you pay was indeed a penalty, greater than the costs they incurred. Otherwise you could face a fortune in legal bills to prove the point.0

Hi, yes the charges must reflect the cost incurred by the bank/building society.
But the question that has been asked is, can you get late payment fees back from mortgage accounts?

Hi Airbag,
I would like to know the same thing. My mortgage company told me yesterday that I have now got £1300 of late payment charges on my account due to missed payments etc. I'm on a sort of court order pay back with them at present and should clear my arrears by May. It was only earlier this year that I've defaulted.

My partner got in a mess with her banking 3-4 years ago and had numerous charges by the bank for failing to meet her mortgage direct debit. I understand she can reclaim and am doing so but what about her charges on her mortgage with bank of ireland? She has now sold the house and settled the mortgage but had to pay £2800 in charges, from memmory each missed payment incurred a £30 charge for the failed direct debit and £25 interest charge plus additional things like arrears transfer fee £120 and £600 solicitors fees etc.
What if anything apart from any overcharge on the redemption fee could we challenge?
Any help would be greatly appreciated as it has always left a sour taste in my mouth0 -

Hi, I'm in a similar situation. I have claimed for nearly £3k in late/missed payment charges & solicitors fees. They have until Weds to respond before i take them to court. Let me know how you get on & i'll do the same. I don't reckon they'll contest it in court cos they daren't, it would open up a massive bag of worms for them. Good luck. SUFC0
