It should be OK. I often find that the tags fall off when you are trying things on anyway, and I've returned plenty of things with the tags missing (although not to H&M).

Am I allowed to return this? Any chance? It's an £8 t-shirt, not a lot of money but still it is equivalent of a week worth of lunch.

Lunch for a week costs you £8!:eek::eek::eek::eek::eek:

A weeks worth of KFC, chicken mini fillet at £1 would mean you could afford an £8 weekly lunch with £3 spare.

    Very doable my friend.

That makes no difference. If the item has been mislabeled and the item of clothing is not as described, she is entitled to a refund.

Well it kind of does make a difference. See below:
    Where you have no rights

    • If you were invited to carry out a thorough inspection of the product and fail to spot a defect which that inspection ought to have revealed
I'd say having changing rooms available is an invitation to carry out a thorough inspection in which the size being too small would have been blatantly obvious.

You won't have any problems taking. It back, especially if you want a medium instead.
I love how people want to jam down your throat that they don't legally have to take it back.. They do because they say so in their returns policy!

Policy is completely different to law. Policy is a rule of thumb and by no means concrete, law is enforcable. However if you note the next thing i'm about to say to dmg24, if the online terms are the same in store then the return is not in line with H&M's requirements for their refund policy.

Does it say anything about the item requiring tags to be attached? Genuine question, it's not a shop I frequent!

From H&M's websitev as a condition to returning an item:
provided that all items have been kept in reasonable condition prior to their return. In particular, this means the item(s) must not have been damaged, soiled, washed, altered or worn (other than to try the item on) and that any labels or tags are still intact

The store may have a different policy though. Optimist offers good advice, be polite and they may offer you a refund/credit note as a goodwill gesture but if they do, its not because the law entitles you to one, its just good customer service on their part. Good luck though.

  • Hello again lovely people,

Just got back from H&M. Guess what, they just refunded my money without any question! Surprisingly they did not even inspect the T-shirt. They just asked for the receipt, put the t-shirt behind the counter and gave me refund.

Thanks for all of the explanation and support x

    Good to hear :)
One important thing to remember is that when you get to the end of this sentence, you'll realise it's just my sig.

No, it's not. Fitting rooms don't have to be used to determine of a garment fits. If the garment is marked with a size, the consumer has a reasonable expectation that to will fit the size as described. If I buy a car and walk around it and don't see anything wrong with it, can it be said that I have been given the opportunity to dismantle it to establish of anything s broken. A defect, which is obvious, is a tear or stain on the fabric, not sizing.

Yes you are correct, but it does form part of the contract the retailer has with the consumer. If they advertise their returns policy, they commit to that condition and if those conditions are not considered to be unfair, they can be enforceable. It wouild be argued that the term was one of the material reasons the consumer bought the item

Can you please provide links to the quotes your using, because I can't find them anywhere on H&M's site. However, I did find this on another site.

6.1 In addition to the cooling off period under the Distance Selling Regulations, we offer our own returns guarantee. If you change your mind or are not completely satisfied with any item(s), Bear League guarantees to refund (or if you prefer, replace) any such item(s), provided that all items have been kept in reasonable condition prior to their return. In particular, this means the item(s) must not have been damaged, soiled, washed, altered and that any labels or tags are still intact. To take advantage of our returns guarantee, simply return the item in its original packaging to us in good condition within 14 days of receipt.

I maybe mistaken, but I can't see the connection with H&M.

Paragraph 6.1 in H&M's T&Cs includes the text...

Blimey, do all online retailers use the same T&C's template.
