As regards the 5/6 year time scale this is determined by the court system in Scotland and I always suggested that users started with 6 years as if the bank decided to pay out before a court action they would pay out on the full six years as a rule and hence the number of success stories giving 6 years charges.
As regards claiming for more than 5 or 6 years charges, this has been argued and won in court but as you would be talking about a large claim this would be out of the jurisdiction of the "small claims" limit of £750 in Scotland and would require legal advice.0 -
stacey I have learned today from a banking employee that the test case going through the courts is not valid in Scotland. I have emailed Martin to estblish the fcts on this one

Hi there i have to attend court in Scotland on Monday for Bank of Scotland who have applied for a stay. When i called the court i was just told to turn up they never mentioned the N225 form do i still have time to complete this and is it applicable in Scotland? I'm really really worried about going to court i just think i will develop severe memory loss and have no clue how to defend myself :eek:

Thanks for your reply, I have the first letter and as I have access to internet banking I have a list of all the charges so I don't need to send the first letter? Just called A+L to downgrade account so that I don't get charged the underfunding fee.
They have charged me £150 for being £4 overdrawn (with the underfunding fee they suddenly decided to put on!!). They are claiming to have sent letters I have never recevied!?:staradmin:staradmin:staradmin:staradmin:staradmin0 -

Hi Folks, I have just found this website and definatley want to try and reclaim my charges from HBOS. Over seven years they have taken sooo much in charges from me and i want to fight back. I need to know if i am right in saying in scotland we can only reclaim up to £750. Should i start the process although there is a test case pending. My last charge was comical, i had a Direct debit taken early from my account and all that happened was that i was re-directed to and from the bank to the company and so forth. No-one was willing to help or refund me yet they agreed something was wrong. Nobody from the bank contacted me when i complained and they have processed the charge. It seems they 'forgot ' to get back to me. I have amassed a small fortune in charges , what do i do??:mad:0

If you don't start your claim now, then your early charges will be time barred if you wait until the test case is over.
