    maximum claim in Scotland is £750
  • its 5 years for scotland, and upto £750 is a small claims, if its up to £1500 it would have to be a summary cause, as mine was over £1500 i got fed up with trying to do it the summary cause way and just went straight to the Financial Ombudsman Service (still in progress)

    It is 5 years. I went straight to FOS rather than the hassle of court, plus my claims were way over the £750. threshold for small claims. It was a breeze, just filled in the complaint form, sent all correspondance between myself and the bank and left it up to them.5 weeks later. RESULT
  • Just done the sums came to £4638 could'nt believe it.As this is way above limit for scottish small claims can anyone calm my nerves about threatening court action please???

    Do we still break the claims down to £750 or less for the small claims courts or can we apply for the whole lot at once using the financial ombudsman?
  • Dont break it down as it will not alter the costs or change the outcome. Go the ombusdman route first as the court action route is taking a lot longer to get anywhere now. Be prepared to accept a compromise if you want settlement early but dont fall at the first offer, unless it is for the whole amount.:cool:

    Ok thanks for the info Apathy, off I go then, lets hope the Clydesdale bank is bored of being awkward and just hands over the charges.
