its 5 years for scotland, and upto £750 is a small claims, if its up to £1500 it would have to be a summary cause, as mine was over £1500 i got fed up with trying to do it the summary cause way and just went straight to the Financial Ombudsman Service (still in progress)totally a tog!:D0

It is 5 years. I went straight to FOS rather than the hassle of court, plus my claims were way over the £750. threshold for small claims. It was a breeze, just filled in the complaint form, sent all correspondance between myself and the bank and left it up to them.5 weeks later. RESULT0

Just done the sums came to £4638 could'nt believe it.As this is way above limit for scottish small claims can anyone calm my nerves about threatening court action please???0

I now live in Scotland, but bank account is with an English branch of bank. Does anyone know which country I should claim under?0

I'd be interested in this also as I've just totted up mine too.
Do we still break the claims down to £750 or less for the small claims courts or can we apply for the whole lot at once using the financial ombudsman?0 -
Dont break it down as it will not alter the costs or change the outcome. Go the ombusdman route first as the court action route is taking a lot longer to get anywhere now. Be prepared to accept a compromise if you want settlement early but dont fall at the first offer, unless it is for the whole amount.:cool:0
