But a statutory right has been breached. In such a case, teh customer is entitled to a full refund including costs of return (which the company will usually arrange at no cost to the customer anyway). The only time the customer is responsible is where the item is returned for, say a change of mind. In the case given, Argos will be liable for all costs. As stated before, the guarantee given by Argos is IN ADDITION to statutory rights BUT CANNOT OVERRULE THEM.

I dont think it has because its described as silver and it is silver as you know there are loads of different shades like if you order a car there are loads of different silver colours , if its totally different to the picture on the website then you clearly have a case.

Hi,

Just been on to Argos customer services, they did try to say that it was excluded from the money back guarantee, but after I explained that it was delivered in a huge box and I would not have accepted it had I seen it. The lady said she was looking at the item and it looked siver, I said yes but have you seen the item face to face, she said no, and agreed to a full refund. I did offer to take another item but it was a 50 day waiting, and the other was not in stock. They are putting the money back on my visa and picking the item up thursday. Thanks for all the advice and I did use say no to 0870.
The item number 4857101, it doesnt look very silver but neither do any of the other items classed as silver.
