  • I take it the reciept shows the products are guaranteed until 15 Dec 2013, then I would suggest this is good enough for the courts should the need arise for a repair action in the meantime. The price offered at the sale was concluded, and the SOGA would be enough to cover this as well.

    The crux is the contract is concluded by the sellers Invitation to Treat (Offer Price in Store) and your Acceptance of offer by payment.

    Therefor, do not take their offer but the guarantee is valid. If you paid by Credit Card, you have further rights under section 75 of the CCA.

    Yes indeed you are correct and I apologise for not making it clear. I had just come off the phone with a very rude man and I suppose it rubbed off on me. I though that there would be people that could offer me a solution to rectify the problem.

    The manager I spoke to was not interested in anything that I said and just kept saying that he will refund me the cost of the warranty.

    How should I proceed? I expect that he will now refund me without my consent and then I will be stuck? which is the reason I am trying to get as much information as possible so I can go back to him today accordingly
  • OK, I would say I do not want you refund, the contract has been accepted by both parties at the conclusion of the sale, Your Payment. The reciept states the goods are guaranteed to 15 December 2013. Should the goods fail before them, take them to court. Note if you paid by Credit Card, use CCA section 75 as well.

    If the goods do not fail in that time, did you want the refund? Note Freddies Ooooogle Box, a Samsung is 2 and a bit years old and apart from the cat, working fine.

    While warranties do give you perhaps a little peace of mind, i think the general consensus of the MSE regulars is that overall, they're a waste of money.

    Under the SOGA you have 6 years (5 in scotland) to issue a claim against a retailer should the goods be faulty, not of satisfactory quality etc. However this doesnt necessarily mean that you have a free 6 year warranty. Obv a £1000 tv would be expected to last longer than that of a £300 tv of the same specs. And some will include accidental damage, which i believe SOGA does not.

    And just because the SOGA says this, doesnt mean retailers dont try and fob off customers. After 6 months the onus is on the customer to prove the fault was inherent and not the result of misuse/wear and tear.

    Try and find the warranty T&C's. Sometimes they offer better protection and sometimes they are full of loopholes.

    I dont think they can ask you for more money after the sale has concluded as offer & acceptance generally = contract and for them to refund could be seen as a breach of contract.

    Interestingly enough, unless i'm being blind (which is possible as i'm not long awake), their website doesnt seem to indicate exactly when a contract is concluded and make no mention that if the goods are faulty, they will cover postage costs. They also have charges for missing accessories which (again i could be wrong but this is my understanding of it) they cannot do as under DSR's all monies paid need to be refunded regardless whether the goods are returned or not, it would then be down to the company to chase for breach of contract. And also the wording of their T&C's indicate that the customer has to return the goods within 7 working days. Which obviously isnt true.

    As we all know, law overrules policy. Worryingly, when i clicked to see the extended warranty T&C's, there were none!

    This is one of those issues where although you are entitled to your guarantee, they will cause a hell of a fuss should you need to use it.

    I, personally, would demand a FULL refund, and go the John Lewis route mentioned above.
    One important thing to remember is that when you get to the end of this sentence, you'll realise it's just my sig.

    Agreed.

    Insisting that the only reason you bought this package was because the extended warranty was so cheap.
