Car Crash/Whiplash Compensation

My friends and I were driving to Manchester via Salford. It was Icy and wasn't the best day to go shopping but being Christmas we needed last minute buys.

Anyway to cut a long story short, going round one of the long corners on the Salford turning and the left wheel hit some black ice.

The car spun a couple of times before rolling down an embankment on the roof about 2/3 times. Luckily we landed upright.

One of the girls had whiplash and a broken hand, myself and the other two girls had neck injury whiplash.

6 weeks later I was only just able to get back in my car and take it on the motorway and now It is still majorly affecting my motorway driving unlike ever before.

The insurance company are calling me back next week (the crash was over 8 weeks ago) and I am not sure what is an acceptable minimum that i should accept.

I have never been in a crash before and it has scarred me, two days ago I drove to Manchester Airport at 10pm to pick a relative up and it really showed me how scared I now am being on the motorway.

Any advice would be appreciated.

    I'm assuming your claim is against the driver of the car, not that you were the driver!

    Have your whiplash symptoms subsided or are they ongoing? My advice is not to accept any settlement until you are happy that you are over the injuries, or at least they have subsided to a level you can live with.
  • Hi . You dont mention in your post who was driving or who actually owned the car ?

    As no third party vehicle was involved (as you say the car you were in hit black ice an spun out of control) it will be the owner/drivers policy you will be claiming from.

    Also , the accident was 8 weeks ago . You do not mention whether the injuries you felt at the time of the accident are still evident or whether they have gone?

  • My friends sister was the driver and she owns the car, I was sat in the back left passenger. She knows we are all claiming.

    My injury was diagnosed as a neck injury from neck down to end of right shoulder, I've been to the doctors three times since however physically I seem to be better now but looking at other post I am concerned it will be ongoing.

    I first spoke to the drivers insurance company 2 weeks after the crash. Injury wise I was covered in large seat belt bruises over my stomach, and generally sore all over and my shoulder has been on going until 2 weeks ago.

    like I said I have never claimed before and I didnt want to accept an amount because I though 500 was the amount we would get but looking through different boards it seems I have really under valued the amount they will pay out.

    Any more info needed?

  • As Quentin has already said, you need to be looking for specialist advice before you entertain any offers of settlement. There is not a set amount of money for 'whiplash'; every case is different. You need to find a solicitor, preferably one who will take your case on a 'no win no fee' basis (called a Conditional Fee Agreement), and let them handle your case. They will arrange for a medical report to be prepared following an examination by a medical expert. The contents of that report will then be used to value your injuries.

    Clearly I cannot offer any definitive advice regarding value on the fleeting information that you have provided, but £500 is almost certainly an undervaluation. As a general rule a four week whiplash injury is about £1,000, which clearly increases the longer the symptoms last for, with a one year whiplash injury now worth £2,850 in the latest edition of the JSB Guidelines. But depending on severity other aspects such as the bruising to your chest and travel anxiety and such can boost the main figure slightly. It depends on the content of the medical report that I referred to earlier.

    So in short, find yourself a solicitor and let them handle your case.

  • If you are truly injured and you are being honest about your whiplash ( as majority of people really go overboard with whiplash) simply do not settle on pre med offer and ask the insurance company you are dealing with as direct claimant for medical report. They will appoint medical agency who will get GP to examine you, he will put forward prognosis and you will get paid based on what the doctor say. SIMPLE
