Can I book holiday in next leave year now?

Hi,

I want to travel to oz in the summer but need to book now. My line manager has told me no as its in the next leave year and I can only book the time off in April when the new leave year starts. Problem is prices will only go up. Does my manager have the right to do this or are they talking nonsense. I have never heard of any law that enforces this?

    Considering a company is within it's rights to inform you when you will be using your annual leave (providing that they give you twice the amount of notice as the leave you will be using) then I don't think they need a law to tell them you can't book holiday until the holiday year begins; that's down to Company Policy.

    Line manager has no legal back up for his position, but it is not illegal either. He is just being awkward for the sake of it AFAICS.

    In your position, I would consider putting the request in writing and ask to be advised within 14 days, otherwise you will assume it is granted. It puts him in the position of refusing you a special holiday, which is quite unreasonable. The other route is to go via HR.

    It depends on your companies policy.
    There is no law they would allow/dissalow him this.

    I would check your company policy and possibly take it higher.

    Depends on the manager, i know my old manager requested we have our holiday requests in as soon as possible (generally started asking for them from January when the temps were out the door) in order to get them laid out in his next years plan - which in turn meant he could notify any potential clashes & sort them out quicker.
    Retired member - fed up with the general tone of the place.

    Maybe it depends on the firm and the manager is just relaying the information, i dont think theres anything written in law as such so its down to the individual firms themselves
  • Why don't you just book the holiday anyway then put in the holiday request on the 1st APril next year. Next summer is a long way you may even be in a different job by then.

    thing is no one NEEDS to book a holiday, they only WANT to.

    If your company has a booking process, and it starts later in the year, it's tough. You can ask nicely but any weight throwing will get you nowhere as you have no weight behind you.

    Er NO! Goodness me, you are so wet about this. She has not been informed it won't be granted. That would be a refusal, which she has not had. The idea is to put the manager to the point of making a decision, hence writing and stating that it will be assumed to be granted.

    As for "that's life", it does not have to be. Any half decent manager would be able to make a decision. For the OP, no decision is worse than a refusal. Tha manager should be forced to decide and if they are going to refuse, they should be bold enough to carry the can for refusing.

    If you look at the ACAS procedure, OP is making a request at least twice the length of the leave in advance. This should allow the business to plan. ACAS make no reference to making holiday requests in the holiday year, so I can only see that the manager should actually make a decision. If it is a refusal, the manager should also be able to offer an alternative.
