    Im still waiting my letter re: the partial payment, then again im still fighting on for the full refund.

    Ok the letter does not state any "final repsonse" but does state that i should contact the FOS should i still be unhappy.

    Is it worth going back to NW and asking them if indeed it is their final repsonse, and again request the total amount outstanding £1050, or go straight to the FOS now?
  • Does it give their reasoning for the refund if any to you?

    Are you aware that banks do not have to refund in full under financial hardship, in fact they don;t have to refund anything until the conclusion of the OFT Test case

    yeah i am aware of that,

    however they have accepted that i am in financial hardship, and have paid me a lump sum that again only covers their overdraft. It hasnt helped me in the short term.

    No harm in trying for the sake of a few letters.

    With the FOS you have to argue that their reasoning is wrong so if you can't argue that then you are perhaps wasting your time hoping when the FOS will agree with Nationwide.

    Hi sorry been on holidayl No, no arrears really so wont be able to do the "hardship" route although there is only my wage coming in as my husband is long term sick.

    Ok so i sent NW a letter asking them if the £450 out of £1500 is their final reponse. They have come back to me this morning to state it is. They stated how they arrived at this figure is that , they state the circumstances of how i went into FH was whem i split from my ex partner back in March 2008.

    I told them it was November 2008? I have argued the fact that they base there valuations on when people experience hardship. It shouldnt be that, the fact of the matter is I am in harsdship regardless of when the problem happend.

    They said "we will comply with any FOS investigation".

    So it looks like I''' have to take it to the FOS know; what do you reckon?
