    Since I started this, ive been putting all earnings there, but because of the snowball effect... They are now saying that I need to pay £300, to clear my overdraft(their charges) then they will clear my £950 overdraft facility.....
  • Please dont loose your patience. I can assure you that YOU WILL win at the end of the day and yes it will take a bit of time and dont listen to the bull**** they are telling you. Keep on pastering and you are the winner and they know full well about it. I bet they will never go to the court. PATIENCE, PATIENCE AND PATIENCE

    thing is, my account at the moment has a £950 overdraft facility.

    Im over the od by £300

    So that puts me £1250 in the red with them... (all because of charged and it going out of hand)


    Thats why they want the £300, but i dont feel its fair that i should pay that, as then its me paying for charges, perfect example, BT was the last DD to be returned... Natwest charged me £120 and on top of that, I still had to pay BT £120

    Im totally lost, dont know what todo.
  • Just got another call from them

    Basically they are saying that I HAVE to pay the money back, they refuse to give me the bank charges back.

    I told them I simply will not pay unlawful charges and if need be I WILL take them through the court process, then they said, that its up to me and they will throw all the defaults at me, make sure that I repay them and finally that they will make sure that I wont be able to bank with them in future.

    If you can prove you went over your limit because of the charges, then as part of the court case (if it went that far) you can also request full removal of the default notice as it was their illegal charges that put you in that position in the first place.

    I find it rather sad how natwest are resorting to threatning people with Defaults for claiming back money that is owed to them.

    Unfortunatly you will have to repay your overdraft im guessing, but if the charges amount to more than your overdrawn, then you can win your charges back (+interest) pay off the overdraft close the bank account and in the process give them them the finger in the process!!!

    Also id suggest you make them send you everything in writing from now on, so you have proof of correspondence for the road ahead.

    I have a record of everything ive sent them (Recorded Delivery) apart from the last letter which i hand delivered at my local branch.

    just chill out...... stick to your time table....and i think as you say the od is being disputed (the charges made you O/D ) i dont think they can do to much. just say the amount is in dispute ect...... just dont pay any money in to the account with natwest....dig your heels in and stick to your timetable...start a court claim as soon as you can and if they phone...simply say you refuse to correspond over the phone and ask them to put anything they wish to say in writing then put the phone down....its just scare tactics.....and remember you are in the right here.....legally and they know it !!!

    claytonv, NatWest for some reason are being especially nasty.

    Firstly, although it's too late for some correspondence, if you get any further calls, insist that you will only converse via letter. Tell them, everything must be in writing. Do not enter into discussion, just tell them clearly and keep repeating until they get the message.

    Next, they should give you 30 days in which to repay any money owed. I know it may be difficult but you need to try and sort out your finances as best you can to repay this.

    Also, despite what NatWest say, if you follow the procedure you should be successful in your claim. The person who called was trying to bully you. It was a dispicable act by a bank who know they're in the wrong.

    If they enter any defaults against you as a result of these charges, you can ask for them to be removed, by the power of the court if necessary. I suggest you include this in any further correspondence with them.
  • Hi I know what it feels like I too had the same experience today with Barclays Bank. I got 3 letters in a week, yes i am scared and worried sick. I wrote to them in August and they offered me 450 .00 which i refused. I responded in writing and they didnt reply. I sent a letter with 10.00 as part of the data request to file a claim, and they now wrote and asked me to return the card and cheque book, cancelled the facilities and threatned to closed the account with defaults against me. Not sure what to do since i am waiting for the requested data. You might find this intimidating but always remain assertive.
