Reverse a Default Notice?

Im not sure if this is right, but can i make NatWest Credit Card remove my Default notice from my credit history?

Im not sure if this is right? I defaulted because my payments snowballed due to charges.

If so is there a link to a form or pro-rata?

I have just made all my letters and worked out what needs paying back lol.

    What amount where you in default for, and at that specific date, what level of charges had been placed on your account?

    Do you have any other defaults on your credit files? Don't be shy... I've had them!

    how long can you go back to claim your charges back, I.E I was with nationwide about two years ago, my account was closed due to me going overdrawn on my overdraft because of the charges?:confused:

    Up to 5 years, after that it becomes a bit more difficult.

  • I have only the one, that i know of. It was for about £550 of which about £200 where charges. It was because of the charges i could not afford the repayment, the classic snowball case. They have now shut the account and i am on a repayment scheme. I just dont want it messing up my already **** credit file.

    There are, of course, no hard and fast rules on this issue since the whole scenario of charges and defaults is quite new.

    The general rule that we seem to adopt on CAG is that, if the level of charges imposed at the time of the default is close to, or above the default value, then you should certainly have a case for the removal of it (which is actually based upon the Data Protection Act principles of supplying incorrect data to 3rd parties).

    In your case, the level of charges appear to be approx 36% - lets just say 1/3rd - of the default.

    In my opinion, you would have difficulty in having the default removed based on the issue of charges. This doesn't mean that you can't include a request for its removal when requesting the refund of charges, but I have to tell that in my experience you are likely to be stonewalled on that by the bank.

    Letters that contain reference to default removal can be found on CAG.

    Requesting the removal will have no impact on your credit files.
  • thank you for your help Jonni2Bad, i dont think i am going to claim it yet. I think i am going to try a completely different track. I feel it along the lines of publicity and contact the FSA (or whatever controller it is) for some advice.

    It is not the end of the world with these defaults (i found another, which they said they would not apply, but did). It just means simplicity for 6 years i suppose.

    I dont know really, might just give them a call and see what they say.
  • Hi Guys

    After seeing Mr. Lewis on GMTV my wife and I decided to reclaim back all our charges as well. We went and did the full thing, sent £10 off, and we received our full statement with all charges in the last 4 years.

    This amount came to £3089,25

    We then sent off the initial letter to Natwest, got no reply. I then sent them the second letter requesting payment and we nothing came back.

    Today I got a call from Natwest asking me to pay my full overdraft in full and hand in my Bank Card and cheque book. I told them that I refust to do anything till ive heard back from them, they then gave me a contact number for the complaints department which I called (0800 015 4212)

    The lady I spoke to was unable to provide me with help and gave me the direct number for the department that deals with it all. (0845 303 9013)

    I called that number and spoke to a guy who told me that I will basically never see that money, my account has gone over £341 no with more bank fees, and he also informed me that Natwest has issued a Default against my name. He told me that I would not be successfull in court and it will take months before any solution is made.

    He succested that I pay £300 today, he will then clear the overdraft and remove the default(which is too late now anyway as it wil remain on my credit record) :eek:


    What must I do, im desperate for some advice here.

    Please advise on this A.S.A.P

    They are calling me back just before 5pm today for payment

    What can / or what must I do?

    Are you able to open up a bank account elsewhere?

    You will get your bank charges back, the banks will tell you anything to put you off but it does take time.

    i suggest that everyone you speak to on the phone from now on , you get their full name and the exact time you spoke to them .
