H & M Credit without permission

  • A similar thing happened to me.
    I pulled my credit report a few days ago and, to my surprise, found that I had a credit account with H&M registered.
    Further inspection showed that they had ran a credit check on me back in November 2010 when I ordered some items.
    My items were purchased with my debit card AND PAYMENT WAS TAKEN so why on earth have they done this???
    I called to find out and the response I got was "Well, we can close the account if you like..." But you've already done a credit check?! You can't remove that, can you?!
    Ridiculous... And clearly not legal...:mad:

    Just to clarify, has the payment been taken from your card or not?

    If not they have every right to expect you to pay.

    If you have paid then you need to send them the proof.

    If you don't pay up then they will more than likely make your life hell!

    It is not illegal to open another persons mail unless you intend to commit fraud - this is frequently incorrectly posted:)

    It wasn't their fault that your card was declined, it wasn't their fault that you didn't recieve all of your post, and it wasn't their fault that you didn't check your bank account and realise you hadn't actually paid for the goods. :wall:

    They should have contacted you before opening the credit agreement, but they didn't, so why don't you just pay for the goods, and close the account?

    You've lost nothing, and in the great scheme of things, this isn't really a major issue, is it?

    Pay what you owe, and move on.

    I doubt your card was declined at all, in fact I doubt the transaction was put through. I suspect this is simply a way to get people to open accounts without realising. Now you have a retail account which you never wanted at some horrendous interest rate, a possible credit check on your account which may affect your credit rating and the hassle of having to close the account. None of this will look good on your credit report.

    Yes you need to pay for the goods, but take the other matter as far as you can!

  • Just to add to my earlier post...
    My situation is even more suspect than I previously thought.

    The items I purchased (and paid for) were actually bought and delivered in September, and the credit check was ran in November.
    2 months later!!! Why on earth did they do this?!?!
    I sent H&M an email today in regards to this, and - after several emails from them telling me that they:
    a) Did not do this without my permission (yes you did)
    b) Did not do this without my permission (yes you did)
    c) Did not do this without my permission (YES YOU DID!)
    they are now investigating the matter... And sending me a £5 voucher (which I do not intend to use, as I am not accepting a fiver a compensation for my privacy being invaded).

    What a joke...

    sorry to bump an old thread, but can either of the affected posters update us on their situation? i'm actually in the same position now - i placed an order in... early april, i believe? and selected to pay by card. the order arrived & i noted that payment hadn't been taken for the items. i actually wanted to cancel the entire order anyway under the distance selling regs, so i contacted them querying the fact no payment had been taken & was told that as i was returning the entire order, the return would offset the amount outstanding and nothing would happen. cue me receiving an invoice today (as they have managed to lose one of the returned items, so they say there is an outstanding balance) with a credit facility of £200 that i do not want, didn't ask for, and will be on my credit history! i'm really hacked off that they did this (particularly as i rang them & queried it, and it was in NO WAY made clear that they had opened a credit account on my behalf, without my permission, when i spoke to customer services) and i want to lodge a complaint but i'm not sure who to go to. i've had a battle with h&m customer service before, so i'd actually rather avoid that and go straight to the relevant authority. i did think that would be online trading standards, but i can't see how to complain to them, can anyone tell me?

    Just to be clear, who lost one of the returned items?

    Did you post everything in one parcel?
    Have they lost some goods from one parcel, or one of a number of parcels?

    Did you send your parcel(s) via a trackable methed?

    You do understand that the goods are the responsibility of the sender until they are received?
    So if they get lost before being recieved by H&M, that is your problem.
