Good spot. Everybody should take a few moments to comment on this. The more comments the better the chance of this ridiculous "keeper liability" being consigned to the dustbin. I will be commenting on the danger of replacing one scam- clamping - with another - private parking invoices. There are absolutely no safeguards for motorists in respect of private parking tickets unlike council ones - no independent appeal, no regulated charge level, no prescribed timescales or process, no prescribed signs or lines, no prescribed format and wording of notices. I will also be making clear that private parking companies have shown themselves to be fundamantally untrustworthy in the past and cannot be trusted to apply such provisions in a fair and reasonable manner.0

agree with previous comments . Schedule 4 is fatally flawed.
The so called Parking Charges imposed by Private parking Companies are PENALTIES no more no less ..some major companies e.g. APCOA even have the temerity to use signage that says as much i.e. Penalty Charge.
Penalties are not permitted in consumer contracts.
Furthermore the attempt to hold a third party liable for a breach of contract by another i.e. registered keeper liable for another driver , drives a coach and horses through all previously long established contract law .
The principle in question is known as “privity of contract” may I humbly suggest that the legislators who drafted Schedule 4 look it up !!
It says this ” The doctrine of privity in the common law of contract provides that a contract cannot confer rights or impose obligations arising under it on any person or agent except the parties to it.”
If schedule 4 is implemented as it stands I expect the Small Claims County Court system to collapse under a deluge of claims and counter claims.
What a wasted opportunity , what is needed is proper independent regulation of private parking companies similar to the regulation that Councils are bound by.0 -

The length of time it is taking to moderate comments is going to lead to alot of unnecessary repetition. Of course, short of adding yet another comment that has to be moderated there is no way of making this observation.My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016).

Is this not the sort of thing where a Facebook campaign might come into its own? Obviously would need someone with the time and knowledge of how to run it but it might get the word out faster and with luck get a bit of media attention.

FB campaigns do seem to gather pace very quickly and there could well be some mileage in this if only to provide some sort of coordination point. Finally, I am a self-confessed FB Luddite valuing genuine conversation over of the exchange of inanities, the sharing of, sometimes, the most intimate personal trivia - and then inviting comment seems puerile in the extreme. You will not therefore find me using it this side of the next millenium.
