MBNA really are just the worst ever, until you eventually work your way through thte 'pay up or we'll send the boys round' departments.
Payplan tol dus to stick to our guns, make a payment of what e could afford each month, and tehre's very little they can do. Apart from take us to court, whereby the courtsd would force them, as well as us, to accept what it considered we could reasonably afford.
We did so for several months, and basically ignored the phone if the display said withheld, or was an unrecognisbable number.
We sent umpteen income and expenditures, with letters explaining our situation, and the tiem scale we expected before things improved.
After 6 months, they are now not phoning, and are reasonably asking me what I can afford to pay, to make a formal arrangement.
As others have said, I would ignore the constant ringing, and just continue to do whatever your advisors have told you to.I ave a dodgy H, so sometimes I will sound dead common, on occasion dead stupid and rarely, pig ignorant. Sometimes I may be these things, but I will always blame it on my dodgy H.

Modify this letter to suit your own circumstances and then send them it by Royal Mail Recorded delivery so that you have proof of sending.

Despite my previous letter regarding ANY communication from your company, which stated that I require ALL communications in writing, your telephone calls continue. You have contacted on several occasions over this past week my parents address. I have not lived at my parents address for several years and I regard this communication as not only a breach of the Administration of Just Act 1970 but a potential breach of Data Protection Laws.
This behaviour constitutes harassment; the letter stated quite clearly to you that I require ALL communications in writing for future Court use. Do not telephone me again - remove any telephone numbers you hold for me from your systems.
Your telephone calls are in breach of the Office of Fair Trading guidelines. If you continue with them after the receipt of this letter an official complaint, together with a log recording the times and frequency of the calls will be passed both to that office and to the Trading Standards office. For your information note that ALL telephone calls are taped.
This type of debt collection method is contrary to the ‘Administration of Justice Act 1970’ in that it is intended to cause alarm and distress to the recipient. Your methods will not be tolerated. A formal complaint, containing copies of all correspondence including yours, will be submitted to the relevant authorities if your calls continue. This will be relevant to questions of your fitness to hold a licence under the Consumer Credit Act, whether or not it results in a prosecution.
Take further note that continued telephone calls after the receipt of a request not to call may constitute a criminal offence under Section 127 of the Communications Act 2003.
Communicate in writing and ONLY in writing, your telephone calls will NOT be answered.
HOWEVER, CALLS WILL TRIGGER COMPLAINTS TO THE REGULATORY BODIES.
I trust that I have made myself understood on this matter.

someone on another site, got the phone calls to stop by asking them for identification. It really stumps them apparently, when they refused the person they had called told them that in that case they would not deal with them and put the phone down. After doing this for a week or so the phone calls stopped. I mean how do you know that they are who they say they are?:DI want a job that is less than an hour driving away from my house! Are you listening universe?

This is McBirnie's letter I sent to them all nearly four weeks ago. I also added a part about doing a DMP and that my DMC would be in touch by November 20th. Didn't make a jot of difference.
They are still calling, I have quoted the relevant parts over the phone.
They are still phoning.
It makes no difference to MBNA, Amex or Capital One0 -

Then get a pre-pay mobile cheap and use the internet banking (for MBNA) to change the number and phone the others, you only need your personal details and the last statement to setup the internet access for the MBNA account.
Just put the phone on silent and ignore it when it rings (but keep a note of the calls so you can quote the times and dates to them later).
Then complain to the OFT and FOS, at the very least it'll make you feel better and do as chevalier says and ask them for identity citing the Visa Telephone fraud as your concerns and refuse to identify yourself, they will get really annoyed at that.

Is it just me, but is there something seriously amiss with the training of some of these collection agents? Very few seem to have any awareness/understanding of the law and the rules that are supposed to govern their activities. Either that - or the more sinister explanation - they work on the basis that most people have no idea of their rights and will simply roll over to their bully boy/girl tactics!0

The Morons started ringing me at work,every single day.Didnt take any of their calls,however was getting rather embarrasing.Discussed the issue with one of my senior managers.When the call came through again,he demanded to speak to their call centre manager.At first this was declined,but then he got the name of caller,and the manager at the time,and threatened them with all sorts.Havent had a call since...although still reciving their letters weekly.
BTW anyone thought of blowing a whistle down the phone at them.0 -

Are you serious? Please tell me you're joking, because if you are serious then you really need to grow up.
That's the easiest way to perforate the caller's eardrum. A woman mentioned this childish tactic on the Welsh consumer programme X-Ray last week. The woman's friend blew a whistle down the phone when a telemarketer called. Result: perforated eardrum and a spell in court.
The person at MBNA is doing their job. Don't expect anyone to give you any sympathy if you cause lasting harm to them.Boo!0
