Hello all,
Some Bast*** won an auction of mine and paid by cheque. I banked the cheque and waited 4 days and then checked my online account, the funds from the cheque were showing so i posted the item.
Almost a week later I received the cheque back from the bank saying it had been stopped. Im know £50 out of pocket.
I had already left feedback but have now followed that up. I have started a Non paying bidder dispute but i dont really understand what thats all about. Basically im just wondering is there any way of getting my money.
Thanks for any help.

try and speak to bank, and state that by default you believed the funds had cleared .. asking them to resend the cheque to the paying bank stating the return was too late...
although fromm barclays
A bank can still return a cheque unpaid even after the clearing cycle is complete and it is included on your statement as part of the cleared balance. If the cheque is returned unpaid, the value of it will be debited from your account even if you have withdrawn the money in the meantime.
OR sue the buyer... you have his name & address

there's vague information on
http://www.bankingcode.org.uk/pdfdocs/Cheques%20and%20Cheque%20Clearing%20the%20Facts%20Sep%2005.pdf
really should work within the timescales shown... if stolen - they might have rights to debit you after that timescale.. but if stolen you know where you sent the goods ... so assume police & banks would be keen for that infoAny posts on here are for information and discussion purposes only and shouldn't be seen as (financial) advice.0 -
There does seem to be an upturn in cheque related problems at the moment. Unfortunately apart from the excellent advice already given about re-presenting the cheque, there is nothing you can do in that respect. Obviously pursue him through the non paying bidder process, and also call up his personal details and give him a call. There is a chance it was a mistake.
I've had cheques returned after weeks but on one ocassion the buyer had made a genuine mistake and was quite happy to resend me a cheque which did clear.
Also never mistake cleared for funds with cleared against fraud. A cheque can be returned for a long while even after funds can be withdrawn against it. There are plans to change this sytem next year, so fingers crossed.

When I sold a lot on ebay I accepted cheques but after speaking to my bank I advised that goods would only be sent after 14 working days. I never lost out but maybe I was lucky!0

From now on the option to pay by cheque will be taken off my auctions.
The guy is ex directory so i cant phone him. I have emailed him today and will send a letter tomorrow. Failling that i will just let his local police officer give him a rude awakening.

God there's some slime balls on ebay. I think my bank charges for bounced cheques! also i don't like the fact that you have to rush out to the bank and keep seeing if they have cleared etc so i only offer Paypal or postal orders0
