Hi - just a quickie, as I'm about to claim for a one-off refund from A&L and am a bit scared!
I am normally about £1000 in credit but I forgot to transfer some cash from my A&L Savings account for a large payment and got charged £25 paid item charge. I phoned up and was offered half as goodwill gesture, which I foolishly accepted.
Anyway, now discover they're charging me a further £25 unauthorised overdraft charge, plus interest, of course. I emailed them to query it, and got a letter back saying that they'd already paid me a goodwill repayment and are unable to consider my request for a refund.
The total I'm claiming is £39.88. Am I likely to get my account closed because I'm claiming this? Is it worth the hassle?
Really don't think they should get away with this, but don't know what to do.C'est le ton qui fait la chanson0 -

I intend to keep the cheque and write to A&L saying I am accepting it as part payment (I have already filed a claim through MCOL), however I'm not sure how to word it. You say to include the words 'without prejudice', but do you mean this should be written at the top of the letter for instance, or should it be included in the body of the letter, and if the latter, could you suggest a way of including this, a sample sentence perhaps?
Sorry if this seems dim, I just want to be sure and get it right!
One other thing, I have already MCOL'd them, if I were to accept this payment in settlement, would that be considered settling 'out of court', in which case, would that mean I couldn't get my court fee back?

I received a cheque this a.m., but have decided it's too much hassle to receive this as part-payment. The following might help you :-

</TD></TR></TBODY></TABLE>You are entitled to the full amount & interest & costs at this stage so you can either return the cheque rejecting it or write to accept it as partial settlement without prejudice and continue to claim the full amount. Your claim will need to be amended to reflect this though. From the MCOL FAQ:
Once the claim has been issued the court cannot change any of the details submitted without an application and request to re-serve the claim. You must complete an application notice (N244) detailing the changes you would like to make and send this to the court along with an N1 completed with the correct claim details. The court will then amend the details, re-seal the claim form and return it to you to re-serve on the defendant. You must keep a copy of the sealed N1. It is then your responsibility to re-serve the claim form. You must then send the court a completed certificate of service (N215) along with the copy of the N1 so the court knows the date when the defendant's response is due.
If this seems like a hassle then simply return the cheque rejecting the offer completely. Good luck<!-- / message -->

Okay, so I'm thinking that to return this cheque (though doing so will hurt!) and keep on track for the full amount may be the simplest thing to do here!!

I have requested just over £1500 pounds in charges and interests. After my first 2 letters they brushed me off so I entered a claim on Moneyclaim, I then received an offer of £358 pounds which I returned, now I have received a solicitors letter informing me of their intention to defend the whole claim. What do I do now ?????0

Dont panic! the banks often enter a defence, I would read the reclaiming bank charges thread all the information is in there, the more information and understanding you have the easier it is.Bewitched2761
