After sending off my template letter listing my overdraft charges I have recieved a letter back from A&L stating that charges have been applied correctly in line with the T&C's of my account and they are unable to agree a refund.
Is this the standard letter other people receive or am I in the wrong? Not sure whether to take this further or not.
thanks0 -
You'll find a lot of helpful people in the same boat with A&L and they'll keep you right

Hi, I've received the letter back from Northampton County Court saying an acknowledgement of Service has been filed on 10th May, the defendant now has 28 days to file a defence. I received the 6 page letter too. What do i do now - does the court send me another letter with a court date?
Also a received a cheque for just over a third of what I am claiming (chq for £560.00) woudl it be best to cut-up and send back to A&L or bank and tell me I am only accepting it as part payment?
Thanks in advance...0 -

Hi mandy,
Unfortunately I ha ve had my court date put back until 26th june as requested by the head Judge in Northern Ireland.
I haven't heard from A&L since I got defence although i did sent Wragge an email asking if they got my paperwork etc and got a letter back saying that they didnt receive it and didnt know of the original court date! I was able to print of the proof of delivery with signature and told - in not so many words - to locate the paperwork within their office as I wouldnt be resending it!!
I wonder what reply i will get?? mmmmmmmmmmmm

So A & L aren't forwarding the paperwork you send them initially to Wragge? I thought about contacting wragge also to ask if they had received my paperwork from A & L but then i thought that surely the fact they don't have all the information will count in my favour come court day? I mean how can Wragge mount an effective defence if they don't have all the information?
If/ When this goes to court does anyone know if i'm allowed to mention that a & L have paid out X amount so far for exactly the same type of Claim? Are you allowed to reference other claims in court?

Got AQ on 18th May. Waiting for a date now. Quite excited now! Can't wait.0

Don't be surprised if A&L continue to use delay tactics ... I've read of a couple of people due to attend court soon and the bank have applied for more time to be allowed in order to negotiate a settlement (as if they haven't had enough time already:rolleyes:). It appears that they're playing for time and hoping for an OFT ruling.
There seem to be loads of people waiting for a court date now (including me), so it'll be interesting to see how they play it.
I really can't see any of these cases reaching court.Wins since 2009 = £17,600MANY THANKS TO ALL OPS0
