Can anyone advise me if i have to pay?
T-Mobile planned to drop the FUP on the data and under OFCOM rules we are allowed to cancel:
9.3 Where the Communications Provider intends to modify a condition in a contract with a Consumer which is likely to be of material detriment to the Consumer, the Communications Provider shall:
(a) provide the Consumer with at least one month's notice of its intention detailing the proposed modification; and
(b) inform the Consumer of the ability to terminate the contract without penalty if the proposed modification is not acceptable to the Consumer
Like many i wasn't told until i saw it on here and had quite a lot of bother with being told i can't and that T-Mobiles rules out reached OFCOM and basically having a hard time of it.
Where do i stand and what should i do or wait for t-mobile to do.
I cancelled on the Tuesday when i found out on this forum and was given my PAC code but today i received a bill for just over £500.

to be honest, i think the fact t-mobile changed that to only upgrading and new customers, after feb 1 means that a bill is justified, as they havnt actully modified your contract.... im still on my 3gb fup.... However as you cancelled, on the tuesday it may be different i would suggest contacting consumer direct0 -

If you canceled due to this change being of deterement to you, and your cancellation was before T-mobile backtracked then it is still valid and you should not pay the bill.
Just write to them and explain your position. If you don't like the outcome of that then take it ofcom and as a final resort to court.0 -

Good advise above but sadly Ofcom will not listen to 'individual' problems.
I take it that have have sent a letter to TM to cancel, giving your reasons. Make sure you have dates, times and names of all people that you have spoken to at TM, as you will need all documents and info. E-mail or send recorded delivery post to them.
You have to deal with the Ombudsman, Otelo. (See the Otelo web site for further info) You have to have first contacted TM at least 12 weeks before you can refer your complaint to them or if you receive a 'deadlock' or 'final' letter from TM. TM will not be happy that you have refered the matter to them because they have to pay for Otelo's service, you pay nothing. If you are not happy with the outcome there is nothing to stop you taking the matter further.
