I owe £7k do i have a case for barclays being unresponsible lenders.

This is a funny one, as in 2009 i remortgaged from woolwich to c+g, i had a woolwich mortgage reserve account which i had used £15k of.
When i redeemed the mortgage, the woolwich reserve changed to a current account, and still allowed me to use the 'reserve limit of '25k' even though in writing it told me it was shut down when fully redeemed.
The temptation was too great and i spent £7k just as 'income' to get by. Now they want it back. :D
Yes i spent it of which im fully prepared to repay it, on the other hand when i have asked them for loans od's etc, they remind me of how they are 'very responsible lenders'. Obviously not that responsible as i hadnt an agreement in place with them.

Do you think its worth a case with the ombudsmen, financial regulation authority, or do you think barclays would they take a smaller lump sum payment.

Any help would be greatly appreciated.:T

    Why can you not just take responsibility for your own actions?

    OP I suggest you go to the FSA and let us all know what they say. You have to be honest and tell us if they laugh.

    LOL I have to agree with the other guys - you spent it love.
    Loan finished Sep 2010 - HSBC CC - WAS £750 now £0! Natwest CC - WAS £1600 now £100 - Overdraughts to be worked on! WILL be debt free by mid 2011!!!

    Epsilondaraconis; thanks for the advice, i considered all opinions and as you all were 'not quite optomistic of my plight' i decided to do the honourable thing and face my debt. :-) Which in all honesty is what i needed. I needed to be told i was taking the p*ss. sad huh !

    Just got off the phone to barclays to agree a payment plan for next 3 years, at the end of the phone call i said jokingly to the collections person, 'would you consider a lower lump sum payment now' amazed he said, 'yes we would, what are you prepared to offer ? ' i said '3k' he laughed and said 'i couldnt accept that offer sir, how about 6k ? ' we negotiated on 5and a half thousand, which i was in a position to pay, as have had a good start to this year. So good result in all.
    I was hoping to buy a new second hand car, when this bill came out of nowhere (i convieniently forgot about it. :-( )
    Its the banks money, which they now have back.
    ALWAYS WORTH ASKING.
