HFO sent me a form after I submitted a CCA

Hi,
I hoep someone can help me.
I have posted an earlier thread here about HFO services harrasing me for an old credit card debt dating back to 2007.
I do owe the money but they have slapped around £3k of their own interest and fees.
I requested a CCA and they have sent me an Information Request Form that they want me to fill out..
So, do i fill it up as I am wary of HFO underhand tactics.
The question (all with yes/no options) are:
  • Do you believe that this account was fraudulently taken out in your name?
  • Do you believe that you may have had this account however you cannot remember the specific details?
  • Do you dispute the outstanding balance?
  • Have you lost you oroginal paperwork relating to this debt?
  • Do you confirm the debt is yours however you contest the enforceability of repayment?
  • Do you think someone woould open an account in your name and subsequently service this account with monthly repayments.
They also want a written explaination for my 'claim' and my signature
(I know not to do that!!)

What shall I do??

    You don't have to provide any of that.

    They however, do have to comply with your request regardless of any of that nonsense.

    How long is it since you sent the request?

    Oooo thats really naughty!

    First of all those questions are designed to build a case against you should/if things go to court on an unenforceability basis.

    As Fermi has already mentioned you do not have to provide any of that information. Ignore it, and once they default on your CCA request they are on the back foot.

    If they state they need that information to respond to the CCA request that is complete rubbish.

    You do not have to provide a written explanation and most certainly do not sign any correspondance!!!!!

    If they do not have a signed copy of the agreement what do you think they will do with that signature you think?!

    I suspected they were trying to lure me into something dodgy.
    Disgraceful behaviour.
    I sent them the CCA request on January 24 and a harrasment letter on the 27th.
    They have confirmed they have received both letters in this latest correspondence but funny enough now I'm reading it again there's no reference to my CCA request.
    They have asked me to fill out the form so it can be directed to their fraud team and other agencies including the police and their dedicated money laundering officer - blatant scare tactics!
    They claim by filling out the form the 'relevant documents' will be provided to me at their earliest convenience!
    They have told me if I don't fill it out within 12 working days they can't process my 'request'.
    Again not acknowledging it is a CCA request!

    So what happens next?

    Utter bullwarks.

    They are just (a) stalling, and (b) trying to scare/worry/confuse you with this nonsense.

    They have a legal duty to comply with the request. End of.

    If you feel the need to reply, then something like the letter here may be appropriate.

    Refer a complaint to the Financial Ombudsman and the Office of Fair Trading.

    Absolutely unacceptable behaviour, though it isn't surprising that it's HFO who are actually stupid enough to put that into writing.

    Don't forget - NEVER provide HFO (or any other DCA, for that matter) with any kind of signature.
