Give way - who has the right?

I've often wondered about this one myself. I've just played it by eye in the past, making the assumption that I do not have the right of way in either scenario
That's the best approach IMHO.
It lowers the risk of coming together with another driver who believes they have the right of way or who just doesn't look where they are going, like our taxi driver friend.0 -
Dangerous layout if you ask me. Are we sure it complies with all the relevant regs? It would make more scence if it was a 'no left turn' out of the side road beacuse clearly the layout actually creates a conflict between traffic as it is especially if the junction is as close as shown in the sketch.PLEASE NOTEMy advice should be used as guidance only. You should always obtain face to face professional advice before taking any action.0

I would class it the same as if it was a parked car you where overtaking, if you have started to overtake, you have right of way, if the other person gets there first, they have right of way. What is pi? Where did it come from?0
-
If you've both got give way hatchings in front of you I'd say its 50-50 so whoever starts to go 1st has right of way.If its a taxi, best just to let them go through usually.0

If it's a taxi, just keep out of his way, probably can't even read road signs.
What is meant by an "island" in the road?0 -
Whoever goes first has right of way.0

Here is the road in question on Google Street View.

I was where the Street View car was but more nearer to the give way island. Taxi was coming out of the side road on the right of the picture.0 -
We had a junction like that near us - there were 5 serious accidents there within 2 months of the "give way island" going in. After installing these at great expense to us council tax payers, they then removed them at great expense to us council tax payers.
The problem was people who were unfamiliar with the junction were pulling left out of the side street, looking right for traffic, not looking left and straight into the path of someone on the "wrong" side of the road who was driving round the island.0 -
the 'side' road does not appear to have either 'give way' or 'stop' signs or road markings...I cannot see what the square sign on the corner states...but it would be in the wrong position for a 'give way' sign.
Therefore, one would have to place a reliance on proving which was the 'major' route?
If I were in the position of the OP....my primary consideration would be the presence of any oncoming traffic on the road in front....and whether, if I moved out, I would compel them to slow, stop or change course....dramatically
This is the basic criteria for any 'give way'....
To deal with the side road, if I suspected a vehicle was approaching the junction, I would make use of my horn...a goodly blast, not a feeble peep!
I would be going through the gap, but as always, only at a speed that I know I can comfortably cope with the actions of a vehicle I cannot directly see.
The whole street, IMHO, does not warrant any sort of speed in excess of 15 mph anyway...too many side roads, with approaches that are blind to me.... schools, especially at the wrong time of day.....
but then, I like to deal/cope with others comfortably...I don't 're-act' when driving..anticipation is the key....I have issues with not wearing out brakes fast enough...anyone wanna buy a brand new set of volvo discs? Never wore the old one's out enough to warrant fitting the new one's.....No, I don't think all other drivers are idiots......but some are determined to change my mind.......0 -

The square sign that you can't see is just a school warning sign that is in my direction. At the time of Street View going past, it had been bent round by vandals. It's in the correct position now.
The road I was on is considered the 'main' road, the road the Taxi came out of is just a little side street leading to some houses.
And yes you can't really do 30 mph down that road, especially when the school is open as you can see, all the staff park along the road turning it into a single lane road. If I had been doing 30 I would of been through before the Taxi jumped out.0
