    How are things going?
If you've have not made a mistake, you've made nothing
  • This tenancy shal be regarded as a short assured tenancy and the tennant hereby acknowledges receipt of the appropriate AT5 notices prior to receipt of this lease.

I didnt receive one of those forms. and have just looked on shelter scotland who sais.
    What is an AT5?
An AT5 is the special notice that your landlord must give you if they want your tenancy to be short assured rather than assured. You must be given an AT5 before you move into the property or it will not be a short assured tenancy. The form should be properly completed or it will not be official.

does that mean my tenancy is not official. if so does that mean he can just come and throw us out if he feels like it?

Never mind what sort of tenancy you have - Shelter or the Council can check that out for you - he cannot just come and throw you out, you contact Shelter or Council if he does (or police if necessary)

Good luck - have you phoned Shelter or spoken to Council yet? (nag nag)

    ok.

I have spoken to shelter, the council, homes4 good and the tenancy deposit scheme today.

He has to prove i havent paid aprently inorder to evict me ont hose grounds, by not issuing any receipts he will find this hard to do.

He is a registered landlord but they are investigating a few things, particularly the gas safter certificate being out of date.

homes4 good say, they will help us if we receive an eviction notice but until then there hands are tied.

shelter phoned back and said he only legaly needs to give a rent book if we are paying weekly, but must legaly oblige if we ask for proof of payment.

we are to wait for the man to phone us back about witholding rent (in the right way) and we have 4 house viewings tomorow.

so far thats all i have but willkeep you as up to date as i can, i am still waiting for some calls back so will let you know when i receive them.

I am waiting for a letter from shelter. also i have been looking for somewere else to live, franticly.

i have an apointment on the 21st (thats the soonest they can see me aparently) at the housing advice place.

and i havent been in the house during daylight hours because i am worried about the landlord turning up and kicking off. I need to go and see him this week to pay marches rent but dont know how i am going to manage to walk in there, and back out again without him kicking off.

not much is really happening at the moment to be honest, I really want to go back to lancashire but am not really in a position for a big move at the moment.

i feel like i am burying my head in the sand at the moment, altho i am really trying to get this sorted out. I know it sounds a bit dramatic but i feel really frightened in my own home at the moment, and i havent done anything wrong. the houses i looked at today were properly minging, I really dont want to live there.

i just dont know where to turn.

Please go out and buy new barrels for the locks and install them. You are allowed to do this whatever is on the tenancy agreement. Change them back when you leave.
