could someone advise me on what to do please.

    Thank you, i havent slept so am a little confused but here is the plan so far?

    Monday morning 9am, call shelter and see what they say.
    then ask the LL for something in writing to say what he thinks i have paid and when. .

    The other things that you need to do on Monday are

    to speak to the landlord regsitration officer at the Council.

    Follow up any advice from Shelter about getting yourselves registered with the Council for housing and check if there are any housing associations that you can register with. if you are kicked out, then it might be easier if you are already on their books.

    Ask whether the Council run a tenancy deposit scheme and whether you are or might become eligible. This would overcome youyr major problem over the deposit.
    in the mean time (ie over the weekend) I am going to sell what i can to try and get a deposit to move, i need out asap, even if i get it sorted this month, what about next month and the month after etc.

    i am also going to pack what i can (ie an emergency bag) because i really dont feel very safe living here at the moment and want to make sure we have medication, nappies, ventilators etc if we need to get out fast, i know that seems over the top but given the gut instincts both my partner and i seem to be having i think its better safe than sorry.

    Do you have family anywhere nearby? Could you store very important documents like the rental record you have kept and bank statements at their house, perhaps with other important documents?

    And if you have stuff that you do not need but value (whether it is clothes the baby is not big enough for or summer clothes for you, say or say photos) can you get that out of the house as well?

    Once this is over and a bit of time has passed you need to report to the tax people all his rental houses as anyone requiring cash is dodging tax.

    the council and housing associations work together in fife, you only fill in one form aparently, you have to be on the council list to get on the housing association list and vice versa.

    they do have a tenancy deposit scheme but you have to be non priority homless aparently

    my family are not close, they are in england so i cant store anything there. I am looking at storage services, altho they are expensive, if anything does happen then at least i know our things are safe. I am actually thinking about moving all non essential items to there for now, that way when we do move it will be a quicker process on removal day, wich is the day i am most worried about.

    thing is, he keeps driving past, so moving things is going to look suspicious, even tho he is being a not verry nice person i want to do everything by ther book, give proper notice etc.

    another tennant has already reported him to the tax office but i will do the same once we have moved.

    Well if he start kicking off and they cannot provide social housing you may be eligible. Ask them on Monday.

    Let it be known that someone in the family has offered you of their old stuff, and you are moving things out to make space?

  • sorry to resurect this iso soon. but i have just been doing more research and it seems i have a problem (ok its evident i have quite a few of them but this one in particular)

    my tenancy agreement states. The date of entry will be 28/11/09. the let will run for a total period of 6 months until and from month to month thereafter.

    ok we wasnt given entry until 7 dec because the previous tennants hadnt moved out yet.



    This tenancy shal be regarded as a short assured tenancy and the tennant hereby acknowledges receipt of the appropriate AT5 notices prior to receipt of this lease.


    I didnt receive one of those forms. and have just looked on shelter scotland who sais.
    What is an AT5?
    An AT5 is the special notice that your landlord must give you if they want your tenancy to be short assured rather than assured. You must be given an AT5 before you move into the property or it will not be a short assured tenancy. The form should be properly completed or it will not be official.


    does that mean my tenancy is not official. if so does that mean he can just come and throw us out if he feels like it?

    I have also found this (one more only and i will stop asking questions)
    5 the tennant undertakes not to keep any dogs,cats,or other pets.

    he knew we had pets before we moved in,

    As you have acknowledged reciept of the AT5 by signing the lease, you are in a weak position to claim you have not received one.

    Play him at his own game. Next time withdraw the exact amount, but don't pay it to him. You have the trail of withdrawals which is compelling evidence you paid, since his records are so poor, and he is almost certainly not declaring the income, and won't take you to court. :rotfl:

    Yes.

    what happens if LL isnt part of it, can they sue?
    This is nothing to do with the tenancy deposit registration schemes. It's where a Council effectively underwrites a bond/deposit for the T ( so the T does not have to find the cash upfront) and the qualifying criteria for this may vary from Council to Council. Tenancy deposits do not yet have to be scheme registered in Scotland.

    In Scotland yes,they do but in Eng/Wales no.
