    Mrs S did unison ever get back to you, or are they having trouble finding their bum with both hands??

    I contacted their women's equality issues section and they said it was down to what was in my contract :mad:

    Sooooo glad I pay subs every month for such useful advice :mad:

    Anyway, I've decided not to let it stress me out. I've just put in my 25 weeks notification letter that I would like them to confirm what my options are for taking my outstanding leave for this year. I'll see what they say to that, and take it from there.

    Hi there,

    I’m hoping you can give me a bit of information and/or advice about where I stand with my current problem. I have contacted my Unison Rep in the company I work for, but he is unsure. I am a Unison member, working at an educational establishment.


    I’m currently 22 weeks pregnant and signed off work sick with pregnancy complications. I have been signed off since week 18. I am probably unlikely to be able to return to work prior to maternity leave, as the condition I have is not going to improve until after birth (symphysis pubis dysfunction). I am confused over my rights regarding annual leave whilst on sick leave.

    I was due to take annual leave from week 35 to week 38 and then start maternity leave at week 38. However, as I am signed off work, this now looks unlikely to be possible, and I would have to remain on sick leave until 36 weeks and then my maternity leave would be automatically started. I would therefore not have chance to take the 19 days annual leave I have accrued, as the holiday year ends 31st August, and I will be maternity leave by then. Our company policies state that only 5 days can be carried over, but I have been pointed in the direction of ECJ rulings (namely Stringer, Pereda and Gomez) which may mean I can carry over more of my accrued leave. My Unison Rep is unsure about the ECJ rulings and what they mean for us, which is why I thought perhaps it would be wise to seek help from elsewhere.

    Our contractual rights are 26 days annual leave, plus bank holidays, plus discretionary closure days which are used at Christmas. Out of this contractual entitlement, I have taken 7 days annual leave and 3 bank holidays have passed (Christmas and New Year). The statutory entitlement, however, is 28 days including 8 bank holidays. I obviously don’t want to lose my annual leave entitlement if it can be carried over to next leave year, but I’m confused as to how many days of annual leave I am allowed to carry over to next leave year, which I would take at the end of my maternity leave. It would be good to have some clear information in case my HR department or manager try and tell me different!

    I’m afraid it depends on what your own company policy says – you will need to speak to someone in HR to find out what it is.

    By all means come back to us if you have any problems getting clear information from them.

  • MrsS if you canBArsed then you prob need to be a bit more assertive with them. Can you dig out that linky I sent you about the recent court ruling and ask them what they think about that...

    or email them and say you want a caseworker to call you back. Its a lot of cash a month to get nothing back for your union subs. I understand though, if you CBA, I am avoiding confrontation at the moment...

    Yes please if you dont mind? Annibee PM'd me her experience a few weeks back and it made me certain I wanted to still go for it, but as It gets closer im still keen to hear how the others have gone. I do remember you saying something about G&t's :D


    I keep buying things ill need and organiseing so I feel its definently happening. i have 3 waterproof shower curtains, a torch (yup, for closer inspections lol), piles of dark coloured older towels. a box with stuff for the baby and me at the ready.
    I have a hospital bag packed for a quick getaway.

    The Mw's are dropping off their stuff when im 37 weeks.

    I'll see what work say in reply to my letter asking about my options .... and that will probably trigger the fight in me :rotfl: I'm trying not to let it get to me though .... I'm on paid sick anyway, so sick or annual leave isn't going to make any difference financially. Not worth my BP going through the roof over I suppose

  • You are totally much more organised than me, and more MSE. I have one damp proof course and a ripped sacrificial duvet cover.

    The torch needs new batteries, but I have got some dorset cereals bars in for snacks...priorities!!

    Right, felt a bit twingy in the back on the morning, sent DH to work thinking he may as well get the morning in. Twinges got more organised. Rang folks to say they should be on standby a bit in case to have DD1. lurked about and ate too much. About 2 ish called DH and said he should tie up loose ends at work then head home (an hour drive) he certainly tied them well, he was ages, think he was a bit nervous.
    Called labour ward about 5 ish, they panicked and said "we haven't got anybody" I just said "well send someone when you have got someone". someone arrived between 6 and 7 as I remember she was very nice, did an exam and a sweep with permission to speed things along, I was 3cm ish at that point. All very jolly, saw DD1 off to g parents, watched telly m/w set stuff up, not much kit really and she didn't leave anything at the house beforehand. Had tea and snacks and watched Big brother and a documentary about transexuals...DH had at least one gin and tonic.
    About ten ish it actually started hurting through the paracetamol, so went on to g and a. We actually nearly ran out of g and a so I would ask them to ensure they bring enough if you think you will use it. M/w went off to get some more. Came back before it was completely out. About midnight second m/w arrived.
    Things started hotting up, and I kept running to the loo, pressure in bottom, and then the need to push, which I did and stage 2 was about 4 minutes!!
    Baby straight on breast, injection given a bit soon and so probs delivering placenta (I've opted for a natural 3rd stage this time since it would be really frustrating to give birth successfully at home, then have to transfer in for placenta removal) but breastfeeding saw to it that the placenta came out. M/w did checks on baby, I had a bath, they cleared up, not much blood or mess really.
    They left us sitting on the sofa, where we stayed all night, gazing at her in amazement!!
