I have opened a claim today as it was posted on 23rd Jan 2011 and it is now 3rd Feb! :)

Then the case will be decided after 10 days.

However as the 23rd was a Sunday I assume you meant it was sent on the 24th and that is only 10 days including Saturday so it is still very possible it will turn up. You have gone for a full dispute quite quickly, most buyers are happy to wait a couple of weeks.

Recorded is only standard mail so is not a guaranteed service. However if at the end of the 10 day dispute the item does not track to showing as delivered to you then you will get a refund. If it does track to you in that time you will lose the claim.

Can't you get some to call the sorting office for you?

Its not fair the sellers being blamed because you haven't checked the sorting office, is it.

You must know someone with a landline phone and its really easy to call them and they can check if its their or not. If its not then OK, proceed with a claim, but if it is just ask them to redeliver it free of charge to you.

Sorry if I sound harsh, but to me it seems like a 'lazy buyer can't be arxed' kind of situation, you can't be bothered to go to the sorting office, or phoning them, and expect the buyer to lose the postage money.
You left it too late to order what you needed, did not request next day special delivery as time was of the essence, but still blame the seller.
  • Yes, I had meant the 24th January as I had paid on the Sunday for the item.

@terra_ferma It's okay. I had only just gotten paid hence why I bought it so late. I have ordered items in the past up to a week before before an event and they have always arrived the day before or actually on the day. I didn't want to pay the extra cost for next day special delivery because I believed that the item would show up in time.

The seller has had negative feedback in the past for items not showing up so it is not just me who has missed out. I have tried phoning the sorting office in the past but I have never gotten through (rings for ages etc) and I am too busy to go there myself.

I am not blaming the seller, I am just wanting my money back because the item I ordered didn't arrive in time and I don't see the point in going to fetch it (if it is at the sorting office) when it will just cost me money to send it back for the refund and even then it may get lost!

  • I never get through and I'm on PAYG so can't afford to keep ringing.

I had wanted the clothing item for yesterday and now I have no need for it. I would rather just have the refund.

Sounds like a lot of excuses, i'm sure you can use a number of landlines from family/friends if you really wanted to call.
Do you think it's fair that you order an item mere days before it is needed and then because now you have no need for it anymore you not only just want a refund, you want the seller to lose out on the cost of sending the item, and you won't even call the post office or pick the item up if possible so if the seller has not written a return address they lose the item too!
The decent thing would have been to ask for a refund minus the postage as it is you who did not leave enough time for the item to be delivered, it is not the seller's fault if the item has not arrived on time if he dispatched it within the time he promised you or within the guidelines set out in their advert by the method you paid for then it is hardly fair that you expect a refund and not to lift a finger to help the situation, and as you opened an Item Not Received so hastily you leave a black mark on their account.

Most of the time my parcels get to people within the time expected but I have had parcels sent first class that took up to two weeks!
Again not the sellers fault that you got paid near the time of your party, you should have insisted on Next Day Delivery if it was that important, you didn't want to pay for that service and therefore took a risk, it did not work out so you should take responsibility.
The seller has had negative feedback in the past for items not showing up so it is not just me who has missed out
Yes but you said that you paid on the 23rd and it was dispatched on the 24th, you were provided with a tracking number so you have proof the item was sent out, rather speedily might I add, so this arguement is totally irrelevant.

It did not arrive in time because you didnt allow enough time, you dont want to pay to send the item back so why should the seller pay for sending it to you?

It is quite common round here for parcels to get held up at the delivery office but for no delivery slip to be put through the door.

    !

As someone has already pointed out you have a tracking number showing item was posted, so what on earth negative feedback for a lost item has to do with your case I don't know.

Personally I think it is a very shabby buyer who would neg for a lost item.

You know it has been sent , so wait your 10 days and if it doesn't arrive then you'll get your refund.

I live in a different city to family and my friends are mostly students so I cannot use their landlines. By the time my OH gets home it is too late to ring the sorting office as it closes at 6pm.

When I get a chance to go to the sorting office I will see if the item is there and if it is I will definitely send it back out of my own pocket. I don't drive so it is an half hour walk to the office.

I haven't given negative feedback, I have gave them positive feedback because it is nobody's fault that it hasn't arrived. The seller paid correct P & P and they aren't in the wrong.
