I think that Brooksy is still waiting for advice as to how to deal with the matter.

If this is indeed a PPC, then Brooksy's best line of defence is to completely ignore any of the bog paper they will be sending. Not to engage into or start any form of communication. Just simply ignore all the useless letters they will be sending to her or the registered owner of the vehicle. The letters can range from begging letters for payment to letters from an underqualified solicitor up to threats to be taken to court and intimidation that the credit rating could be affected. In all of these cases and in view of the considerable prices charged for loo rolls, we should make Brooksy aware that her best hope in this lengthy process is that the company prints their empty demands on paper which is highly absorbant and with that the ink used is moisturising for use for the more sensitive areas of the human anatomy.

  • Oh OK.

I meant that if a debt collector came to the door or something I would give them a photocopy and send them packing.

But fair enough, I will ignore everything totally.

    Thanks

Illegal but worth a punt for them if the unsuspecting motorist coughs up.

I would probably go as far as fraud actually,

    Fraud Act 2006

    2Fraud by false representationE+W+N.I.

(1)A person is in breach of this section if he—
(a)dishonestly makes a false representation, and
    (b)intends, by making the representation
(i)to make a gain for himself or another, or
(ii)to cause loss to another or to expose another to a risk of loss.
    (2)A representation is false if—
(a)it is untrue or misleading, and
(b)the person making it knows that it is, or might be, untrue or misleading.
(3)“Representation” means any representation as to fact or law, including a representation as to the state of mind of—
(a)the person making the representation, or
    (b)any other person.

I think I would be having a word with West Mids Police, they'll probably say civil matter but id push for making it official, ask for a seargent or inspector.

Could she, under these circumstances, not report them to the CIB straight away?

    LOL :rotfl:
  • the posts in the link also state the company is dormant?

changed addresses more often than changing a pair of socks?

if it stated its a PCN, then call trading standards, take a photo copy of it and send it to them. with the location it was issued.

I doubt that would happen unless the debt collector is on their own paylist. Even if this should happen: Don't let them in, tell them in the nicest possible way (which for me personally would be bordering a painful experience) to 'GO AWAY!!! If you don't, then I have to call the police! You are trespassing and this against the law!'

(Even writing this as a spiel to you so goes against my personae lol )

CIB, do you mean CAB - if so never ask them about PPC fake PCns as they have no clue!

Trading Standards and OfT should show interest if the OP points out the company seems to be dormant and the invoice is being passed off as a Penalty Charge (other PPCs have not used this word for a couple of years except by mistake).

I wonder if the landowner still has an old book of these DIY invoices and is issuing them himself as a deterrent. Still illegal though, and where would the money go if any mugs actually paid?

Brooksy, complain and cite the Fraud Act and Administration of Justice Act, both already linked.

Oh and debt collectors don't knock on doors, they do phone up sometimes but they can be told where to go and threatened with harassment charges. They are NOT the same as bailiffs.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Think that must be the easiest one I have ever seen to ignore! A paid for P&D and a invoice saying "Penalty" Don't see how they could explain that to the Judge! Your honour our accident-prone typing Monkey, typed Penalty instead of parking!
