As others have stated, the OPs insurer will bear responsibility for this however this is an agreement between insurance companies and the MIB, not a legal requirement. Legally the OP is not in any way liable and any small claims court case against the OP would fail.......
Lum, it's nothing to do with MIB, it’s S151 of the RTA, link in post #90 -
if your neighbour can get her car fixed for £150 then why would she consider putting it through her insurance if that is going to cost her £300 and higher premiums in the future?? she's not, she is just hoping you will give her the £150 so she is not out of pocket but in my opinion its not your fault and you shouldn't pay, hope things work out for you
wouldn't it be nice if i won : car/cash/family holiday
:j I am a winner! :j

Just spoken to directline and got through to someone who actually knew what they were talking about this time i told them about the coversation with the neighbour etc and she put the incident down as theft. Apparently if the robber gets found guilty at court then i will have the 2 years no claims bonus that i could potentially lose reinstated. I dont have to pay any excess like stated above and if she comes pestering me again i have a claim number and direct line will do all dealings with her. She said no reputable insurer would tell the customer to come and ask for money and were there any witnesses etc. I presume mine and her insurance companies argue it out amonst themselves, so far no claims been made against me and her car is still parked outside her house although it was supposedly going to the garage first thing this morning, and thats why she wanted the £150 asap to cancel the repair done via the insurance. Whats the world coming to when we all to pay for the crimes of others. I was so shocked when she said it was my fault because i was robbed is she for real?0

Good news Shelleuk, at least it sounds like it!
Might seem easy for me to say but try not to get too emotional and worked up about the situation and your neighbour.
It wasn't your fault that you were burgled and not your fault the neighbours car got damaged.
You have done the right thing and suggest you leave it in your insurers hands, refer your neighbour(calmly) to your insurers also.
Good news about the potential of getting your NCD reinstated.0 -
Thanks, i lost my rag with her before and slammed the door in her face before telling her where to go when she said im responsible for it. Its going to make living near her hard and i wondering if i should have coughed up £150 quid. I think shes bitter because her plan didn't go her way. I dont understand why shes left this untill now when i was willing to sort everything out when the incident happened. The other halfs a police officer and is wondering what shes up to.
Im bracing myself for her knocking on again0 -

i wonder if she is planning on selling her car and thats why she wants it looking better now, either that or someone has told her to try to get what she can out of you. You could offer to pay £75 (half of the £150), if you do decide to give her the money i would give it to the person who fixes her car and get a receipt, you may give her the £150 and she may not even bother to get her car fixed or she may deny you gave her anything and still involve her insurance.wouldn't it be nice if i won : car/cash/family holiday

...Im bracing myself for her knocking on again...
You've nothing to say to her, other than contact her insurance company.
Looks like you are sorting this as well as can be, given the circumstances.
It is an unfortunate feature of crimes such as this the victim often loses out financially.0 -
Im really upset over the whole thing. Its not like me to lose my temper and tell someone to #*&^ off. I just cant believe she said the whole incident is my fault for being robbed that caused me to flip. I have only just started sleeping again since it happened its not nice waking up to a man stood 5 ft away from you. Im in this house on my own with 3 young children most of the time and feel like i can't protect them. The other half got injured chasing his accomplice who was waiting on the driveway to get in my car and a two inch scratch to her wheel arch is my fault too.0

If it was me I would write a letter, detailing the information that your insurance company have given to you, and directing them to the insurance company in regards of all future enquiries concerning this matter.
If she comes round again simply tell her to leave your property and to contact the insurance company.
If she continues to harrass you, tell her you will phone the police and let them deal with it.
It's awful when you have people like this affecting your life, but just remember, you have done nothing wrong.[SIZE=-1]To equate judgement and wisdom with occupation is at best . . . insulting.

Your car was stolen. So you will claim from your own insurance.
Your neighbour's car was damaged by burglar driving your car. But since he was not owner, he was essentially driving uninsured. So, your neighbour can't claim from your insurance! She must claim from her own insurance.
After just one claim, premium won't go up too much (may be 20-30% more max).
Sorry but that is wrong, the claim will be against the op's policy, sounds wrong??. Maybe, but that's how it works.I like the thanks button, but ,please, an I agree button.
Will the grammar and spelling police respect I do make grammatical errors, and have carp spelling, no need to remind me.;)
Always expect the unexpected:eek:and then you won't be dissapointed0
