Burglar stole my car, scratched someone elses and i have to pay?

  • My guess is that she wants it fixed and it would be her insurance which she would be claiming under and would rather you pay than she lose her NCB !

    Your neighbour is trying it on,tell her to do one, 3mths after it happened and its just bothering her now,why wait so long she must be a bit slow on the uptake.Do not give her any money let her contact whoever and let them sort it she sounds a bit of a nutter to me.

    I reackon shes going through her insurance and wants me to cough up half of her excess. Shes already told me her premiums will go up, she will lose 2 years NCB plus shes got to pay £300 excess. But on the other hand why would she go through the insurance if its only gonna cost £150 to be fixed. I think she is up to something. My partner just got back from work and said she stopped in the street and seemed a little taken a back when he told her that we had contacted our insurers about the impending claim. I think her plan may be to bluff me about the insurance in the hope that i wouldn't want them involved so i would give her some money to keep them out of it. Im going to tell her to go through the insurance because something doesn't seem right and see what happens. I dont have £150 to give her right now, in order for her to cancel the insurance claim. I can't believe that i get my house robbed, see him in my house, get told i have to pay £150 to have my car back from the impound, the police have had my mobile phone for 3 months and now she wants money off me for her car to be fixed. I have to suffer because some chav decides to rob my house (i give up). At least he in prison untill the case.

    If you are right and she is going through her insurance then they can/will come after you to recover their costs so what i said in 9 & 11 above applies

    You are missing out several very important bits of information in your post:

    1. have you claimed on your insurance for the damage to your car? If you have or are doing it shouldn't change what is going to happen to your policy and NCB to add on the damage caused by the theft of your car to another's car.

    2. Did they catch the burglar? You don't say. If they did then everything could be claimed against him and you don't have to wait until he is in court or convicted. Your claim is a civil matter unrelated to the criminal case, although a conviction would make your claim much easier.

    3. What does your insurer say? All you tell us is that they are useless.

    Unless the thief has any assets (unlikely) then pursuing him for any damages will more than likely be a case of throwing good money after bad.

    In answer to the above questions

    1 I have not made a claim on my insurance for the damage to my car. The dent in my boot knocked out, and im TPFT so would not be covered anyway

    2 They caught the burglar in my car 10 minutes later. Who is now in prison untill the court date

    3 The insurers just wanted the crime reference number and nothing else. The girl on the phone didn't really know where i stood so i just gave it to her and left it at that, they seemed concerned that the other insurance company had authorised a repair without even contacting my insurer thats why i asked and her only concern was why the other party had left 3 months to claim.

    I think its best if the insurance sort it out

    The OP says the burglar is in prison until the case comes to court.

    While the judge can make a compensation order as part of any sentence, it is unlikely because the burglar is most unlikely to have the means to pay, although you never know.

    On the other hand, judges are urged to consider victims more than they used to.

    The victim will be asked by the police to make a victim impact statement in which she will be invited to say how upsetting the whole thing has been.

    Nothing to stop her mentioning financial loss at this point, and asking to fill in a claim form for compensation.

    Don't quote me on this but surely damage to your care would be covered as it is part of a theft??

    Do your insurers know of the theft, you "should" inform them. However that alone will create a hike in premiums, but it may not be much greater if both parties put in minor claims.??


    It needs thinking about, but although not strictly legit paying her off "could" be your best option, your choice I think.
