Burglar stole my car, scratched someone elses and i have to pay?
I posted on here a while back about being burgled. To cut along story short i was burgled before christmas, they stole my car and whilst reversing off the drive way they scuffed the women who lives opposite car (no one saw this), my car was recovered ten minutes later with a cracked bumper and dent in the boot. I phoned my insurer and they put a mark on my file to say what happened. Spoke to the women at the time who said she had phoned her insurance and they told her she would lose 2 years no claims and would have to pay an excess of £300 and her premiums would increase. So she said it wasn't worth her claiming and she was gonna leave the scuff. Now 3 months down the line she knocks on my door saying her insurance company are fixing her car tomorrow so she wants my insurance details to reclaim the money. I gave them to her, but is this how it works. I didn't even do the damage it was the bloke who stole my car surely it should come off that uninsured drivers policy. Will i lose my 6 years no claims bonus although i didnt cause the scratch? We are both out of pocket because of the robber, nothing like this as ever happened to me before so i don't know what happens next especially sinces its not a straight forward case. She knocked on today saying her insurance phoned her this morning to get her to settle privatly with me and she knows someone who would do the scratch for £150 quid if i was willing to give it her so my insurance wouldn't be involved. What do i do? My insurers are useless.

As the driver was not insured at the time of the accident surely this would be an MIB claim?0

MIB have an agreement with insurers which means that if there is an insurance policy on the vehicle (even if it's stolen/driven without consent) then they will deal with the claim as the "insurer concerned".
I don't know if this will affect any NCB - in theory it shouldn't.0 -
The other party's claim seems to have reduced to £150, which sounds reasonable, you can't get much bodywork done for that.
The OP seems to be in contact with the other party, so I wonder if a negotiated settlement with her might be the best way of putting this matter swiftly to bed.
Perhaps the OP could suggest going halves on the damage, or maybe offer £100. "The damage wasn't your fault, but neither was it mine."
Could save some messing around and possible premium hikes in future.0 -

Always an option, but she will then go back to her insurer who will go to the OP's insurer who will almost certainly stick his premium up even if they can't knock his NCD because of the circumstances.0 -
I think something is fishy too. Its like my partner said why would she go through the insurance at £300 when she knows someone who will do it for £150. I thought everything was above board untill she said £150 and the matter would be dropped. I mean shes already getting it repaired (through her insurance apparently) tomorrow without even giving her insurance company my insurance details, and then conveniently the insurance company are encouraging her to sort it out privatly. Ive took pictures of the car incase she starts taking the mick. I mean it happened 3 month ago now and i know she is going to be annoyed becasue shes got a scratch on her car through no fault or her own but so have i. I think she thinks because it was my car that did the scratch then im guilty of doing it. My insurance company were not even sure about the whole thing. The thief is in court soon so i think im going to tell her to go through the insurance so that everythings above board. She even mentioned that her insurance said she will be able to claim against him if he gets found guilty at court. At the end of the day i think its really trivial when i had to experience the ordeal of waking up on the sofa to a man with a scarf around his face whilst my boyfriend was in bed. My excess is £100 so i will just pay that if they contact me. I just have a feeling that im being bluffed it adds insult to injury.0

I think RTA s151(2)b http://www.legislation.gov.uk/ukpga/1988/52/section/151 extends your policy to include "all persons" (including thieves) so if your neighbour pushes it your insurance will pay.
Depending on your insurance company this could go down as a fault claim on your record, knock 2 years off your NCB and cause loaded premiums for the next 3/5 years.
I'd have a hard think about agreeing some solution that doesn't involve your insurance

Thanks im third party fire and theft so i presume i wont pay anything then because im not claiming for damage against my own car. I wont be driving much longer anyway. Im a stay at home mum so dont really need to have a car. I think the insurance would be my best bet thats what i pay my premiums for. I can't see why i would get a fault claim when i wasn't at fault. Im happy to wait till the court case but shes having it fixed tomorrow unless i cough up £150 quid for her to get it done somewhere else.0

"fault" has a different meaning in the weird & wonderful world of insurance and "fault claim" = any claim where the insurance company don't get the money back from someone else
If you are giving up driving then for 3/5 years then, as you say, you might as well let the insurance company deal with it but be careful if you are a named driver on any other insurance policies as your claim will also have to be declared on their policies with the resultant increase in their premium0
