Yes, seriously.
Either she pays back the £1700 ish owed from her capital, and then continues to have her income reduced by £10 per week
Or she keeps her £10K and accepts a £16 per week deduction in her benefits and repays the debt at a decent amount per week.

I was in a similar situation when claiming JSA only this is i declared everything on the forms when first claiming JSA, i had over 18,000 in a bank account was told i only sign for my NI credits, 3 days later i received a giro for full jsa. I had the interview under caution, now i have to pay an over payment of £122. Moral of my story is either way you are screwed.0

That will not work; it would be regarded as deprivation of capital.
If the OP had wanted to organise this so the money was safe for her son, she might have been able to agree a deed of variation with the other beneficiaries of the will before it was proved, so the money went straight to her son. Too late now.If you've have not made a mistake, you've made nothing0 -

I would want to give any child of mine a good,if not a great life. Especially when they are young and can enjoy all the world we live in can provide. If I had £10,000 in the bank then they would have a fantastic life, and forget the idiots who moan about consumer products etc. Now, not possibly in 10-15 years
Who is to say that university will be a viable option when the son is old enough?
I think the OP has been caught out trying to fiddle US out of our money. Wants her cake and to eat it too.
If she was really honest, as she wants us to believe, then that £10,000 would have been put into an account where she had no possible chance of access.

You have a good point BT, I didnt see it that way. And a court or member of the Jury might see it that way too.
Its just that having access to 10K has never been a big issue. Ive never been a high earner but I am in a relationship with a high-earner academic girl who is just as naff with cash as me. We have never been without it, but its never been the be-all & end-all. The novelty of wealth does wear off though, that holiday brochure or nice car is only desirable if you cant afford it.0 -

Oh yeh living on benefits is the life of riley. Do you have any idea how little Carers Allowance or JSA is? You have to pay for all your bill out of it and what not it's not a big wad of spending money. Sure if you play the system right you could get loads but you'd also be committing fraud and most people on benefits aren't. They're people fallen on hard times who shouldn't have to suddenly go from a comfortable living to sitting in a cold dark house eating value baked beans because they have no money for the leccy meter, can't afford heating and they have no money left because that week there was a hole in their son's shoes and they needed to pay for a new part for their boiler/washing machine/etc.
Sometimes benefits do fund a life of riley but it's a common misconception that if you're claiming you're sorted. Judging from what the OP said she should have declared her savings, she should have lived on them but in the meantime she was hardly living it up while the taxpayer footed the bill.

Benefits are the life of riley. You sit and moan about the pittance you get every week. what right do you have to moan? Its FREE MONEY. You should be thanking the tax payers - without whom you would starve - not sitting moaning. Its that attitude that winds up people like me, as we work, pay your bills, and are struggling ourselves, yet have to listen to people who do nothing more than sit on their butt all day - moan about how skint they are!The opposite of what you know...is also true0
