Non recieved item.. stroppy seller!

Please advise!!
I paid for a baby toy through paypal at the end of September.. and it never arrived.
i emailed seller a few times, and they eventually contacted the post office, and told me they would refund me in full once they'd heard from P.O.

I kept in touch, not pestering, but asking how it was going, and always got the reply- i shall let you know when i get your money back.

I am getting fed up of waiting, so emailed her today asking for my refund as i'd like to replace the toy i should have got with another one.
her reply...
' I don't take kindly to being dictated to, so once i have MY money back, you will get yours'
i wasn't impressed, as its not a huge amount, but states her cheque from Po is in the post- surely you'd refund sooner than 7 weeks after the item didn't arrive?!

Has any one else ever had this, and what can i/should i do?

    I had an tem get lost in the post which I had to claim for, but I just refended the seller straight away while I was waiting to hear from the PO.

    She seems really stroppy, and if the item isn't that expensive, I don't see why she can't just refund you.:confused:

    If you are still in time, which is 45 days from payment, thenstart a paypal chargeback immediately, do not delay any further.

    If the seller cannot prove delivery of your item then paypal will rule in your favour and assuming funds are available return them, or else chase the seller for them. If you paid by credit card on paypal then your position is even stronger as you can always fall back to them of paypal fail to recover monies.

    The sellers claim with the RM is nothing to do with you, you have a 'contract' with the seller for your item, it is up to your seller to reclaim her own losses later.

    Depending on when you bought the item though you are very close to your chargeback limit, so act quickly. Log into paypal, then click on the tab at the top 'resolution centre' and follow instructions from there.

    I know that in the past i have refunbded someone, then waited for my royal mail claim... not the other way round.

    I have just filed a dispute- but the web page from paypal stated ' you cannot file this claim with this type of item'
    ??
    I have counted the days, and it is just within the 45 day leeway, what can i do now?
    I have contacted the seller again and stated that she is breaking her 'contract' with me and a non recieved item dispute will be opened if she does not refund me asap...
    Not sure what to do now!

    ' Go ahead, file a dispute.. I shall jsut tell ebay what I am doing. Do not dictate to me'

    She needs a wake up call. That said, I wouldn't have warned her about the dispute.... it's a great opportunity for her to empty her paypal account.
