Well, they're back! Letter three - this time its from Roxburghe Debt Collectors (PO Box 342, Lavender Park Road, West Byfleet, Surrey. KT14 6YX).
Its says "In the absence of payment or any valid appeal we are instructed to pursue this matter to a conclusion. In a further effort to resolve the outstanding PARKING CHARGE NOTICE that was issued against your vehicle, please find below the relevant details

In line with the Terms and Conditions of parking at the above location the amound due now includes late payment administration fees.
If we do not hear from you within 10 days we will pass the matter to our solicitors Graham White who will review your case for potential legal action
We are fully aware of anecdotal information being presented via the internet and on various websites and you may well feel this guidance is worth following. We strongly urge you to seek independent legal advice rather than rely on these opinions and we would respectively [sic] suggest that you refer to the Civil Procedure Rules part 31 and more specifically parts 31.16 and 31.17. Roxburghe and Graham White are the same people, so they will be reviewing all they like, the conclusion will be that they will move onto another mug who will pay up, I trust you won't be a mug by paying the scamming 419ersExcel Parking, MET Parking, Combined Parking Solutions, VP Parking Solutions, ANPR PC Ltd, & Roxburghe Debt Collectors. They are all or have been suspended from accessing the DVLA database for gross misconduct!

They are telling lies. "Civil Procedure Rules part 31 and more specifically parts 31.16 and 31.17." do not apply to claims going through the Small Claims track. So nothing to worry about.What part of "A whop bop-a-lu a whop bam boo" don't you understand?0 -

My bad. If I had actually read the site they referred to properly I would have seen that. Doh.
http://www.justice.gov.uk/guidance/courts-and-tribunals/courts/procedure-rules/civil/contents/parts/part31.htm#IDAAKGT specifically says applies to all tracks bar small claims and 26.6 http://www.justice.gov.uk/guidance/courts-and-tribunals/courts/procedure-rules/civil/contents/parts/part26.htm#IDAZOSIC clarifies nicely when claims are allocated to the small claims track (under 5000 it seems) and finally http://www.justice.gov.uk/guidance/courts-and-tribunals/courts/procedure-rules/civil/contents/parts/part27.htm#IDAQ2UIC specifically dissallows section 31.

I would be very grateful if I could also ask advice on a similar parking situation.
I parked in a Lidl car park last September and had no idea it was a paying car park. I returned to my car and drove off and, as there was no ticket on the car, I didn't know that anything untoward had happened.
About 3 months later I started receiving letters saying I had been issued with a fine and as I hadn't paid it I was being charged an extra £71. I wish I had checked on this site first but instead I spoke to the OFT who told me to write to them and explain my position. Given I have had several incorrect council parking fines (and mistakenly thought this was the same thing) which I had cancelled taking this approach - this is what I did.
I also called Roxburghe and stated that I was following the official complaints procedure (as outlined by the OFT) and therefore they had to put my account on hold whilst it was being looked into. I requested evidence of the 'ticket' that had been issued on my car as it was not there when I returned and they said they would send photos. Since then I have received texts and further letters from Roxburghe and now threatening letters from Graham White showing clearly that they have ignored my letters and my account is clearly not on hold. I spoke to several members of the Roxburghe staff upon getting the text messages who have said that they are now not sending photos as they 'don't have to'
My one concern is that stupidly in my earlier correspondence I did admit to being in the car park and said that I was disputing the additional fee that I couldn't possibly have been liable for as I didn't know about the fine rather than the £60 fine.
Have I left myself liable by doing this?
I have to admit to feeling quite worried every time I get a letter and text and I have complained to the OFT about this threatening behaviour. Is there anywhere else I can complain to about this? I can not believe these companies can be allowed to go around issuing threats and behaving like such bullies without there being some recourse?
