    been for my appeal today,all was good the area manager conducting appeal basically agreed with most of my reasons for appealing my unfair dismissal my question is what will my options be if they offer my job back,do i have to take it,can i still take this to tribunal and get compensation,can i have job back and smaller compensation for the unfair dismissal is there any other options,does it affect compensation if i dont take my job back

    How do you feel about working there? Will the accusing manager be reprimanded, or investigated? Is there another location you could be transferred to? Will they be paying you for the lost time?

    yes they are re-investigating what i appealed on 13 points including disability discrimination and sexual discrimination plus normal discrimination i get the verdict in about two weeks but im more than hopefull:obut im unsure if i would want to go back now after this episode,yes there is another location where i live,one of the managers already gone to another store

    i wouldnt think they will uphold my dismissal and risk the tribunal route they wont want this,i would be amazed after the meeting today if they were to do that

    Having been involved with many appeals - it is best to wait and see what the outcome is without attempting to predict it. Of course the person hearing the appeal will have appeared to be sympathetic, but ultimately, he/she will be seeking an outcome not specifically beneficial to you, but what is best for the company and if it has been decided that the company were at fault, I suspect that won't be made common knowledge.

    As this is a large well known high street organisation, any adverse publicity would not be in their interest either nor would highlighting any management or operational shortcomings.

    I wonder if damage limitation in the form of a C.A. will be the outcome - however, whatever it is, I hope it's right for you.

    You have appealed against your dismissal, however, did you indicate at your hearing that you were unsure as if you could work for the company again?

    Incidentally, did they give you any indication as to when they would inform you of the outcome of the appeal?

    You can bet their legal team will be on it as we write these posts.

    EDIT - You have answered my penultimate point as I was writing. Two weeks seems a long time.

    Blimey, how did disability and sexual discrimination get thrown into the mix?

    So no verdict yet? And you're already asking what your options are?

    Wait and see what the verdict is before weighing up any options.
  • maybe because they are totally revisiting the case from the beginning and interviewing everyone involved again

    you dont always see these things until you need too,and i didnt make too many noises about it before in case it caused problems with my job,but there is no reason to keep quiet now is there,but best to know my options,best be prepared like i was for the appeal and to know exactly were i stand stops them trying to get one over me

    Which is the right thing to do of course, but what I think FakeIrish is questioning is that the discrimination and disability aspect was not relevant to the actual dismissal situation which was the missing cash.

    Not necessarily, it could be argued that she was picked on because of her disability. It may have been the reason why she was singled out to be accused, because it might have been assumed she wouldn't make as much fuss as someone with full hearing; an easy target, if you will.

    no but its very relevent if it goes to tribunal as it is a reason for wanting to get rid of me,and if it goes to tribunal they have to show reason to sustantiate why they dismissed me i.e evidence which they have nothing,at the end of the day if it helps my case its relevent and i and the union think it is as did the interviewer today(and before i went in to interview today i thought it mint be dismissed out of hand but it wasnt)
