Waiting for operation so my employer has made me redundant and I have appealed

    Did they not provide you with the scoring process? IE what basis they chose the other person?

    I did receive a scoring sheet with my redundancy letter.

    I have just checked my insurance and I have legal cover which covers family members to do with Employment but I am excluded for the first 90 days of cover and the insurance was started on December the 12th 2010, my insurance booklet states exceptions in the Employment part " A dispute if the date of the incident is less than 90 days after cover started " but what is the date of incident ? Is it the day I found out I could possibly be made redundant or the day I received a letter telling me I was redundant or the date of my appeal to my previous employers or the date the Tribunal service accepted my case as this was the 9th of March which is over the 90 days of qualifying so is the 9th of March the first time my redundancy has become a" legal matter or incident " in the eyes of the law or my insurers ?

    ooh good luck with this I had similar probs and was lucky to be offered settlement but I had crabby reference after..be warned!!

    Had a reply yesterday from the court dealing with my claim, enclosed was a defence from my ex employers solicitor and a covering letter from the court saying a date will be set for the hearing but when do I submit my evidence ?

    You really need to get legal representation asap as they would be doing this for you.

    At risk of redundancy is just that, at risk. At that point in time the decision hadn't "on paper" been made. Check this with your insurance company but I think you will find that the date of issue (not receipt) of the letter will be the incident date.

    I have just found out I qualify for legal aid and my home insurance would not cover me due to timescale from the date I purchased it.
    So I am pleased to be getting some legal help.

    I have just spent an hour on the phone to my solicitor who thinks I have a very good chance of winning my case :D

    Update, tribunal date set for 3 days in Feb 2012. Nothing else much hapened other than my former employers accepting i have a disability.
