Bought a clocked car

Hello again,
Well here i am 14 months down the line and as promised im getting back to the forum with an update.
Trading Standards have investigated the individuals in question and found false names and addresses.The person i bought the car off as expected given me the wrong name and is in partnership with a couple of other lads and it seems between them some of them have 3 addresses and have had 9 credit cards in the last year alone.To date they have bought and sold over 170 cars the guy at TS have wrote to 7 of the owners of these cars to speak about their vehicles purchased off him which none have got back to him.The bank accounts have been looked at of the individuals,the TS guy even went to the auctions with a police officer and the case seemed very strong until it was submitted to court and someone there has said they will not be persueing it as it will be hard to identify him so will drop the case even though he is still buying and selling cars.
Is this normal???
So came the question if i was to sell the car on without letting on about the mileage what would happen if the new owner found out about the mileage and went to TS,what would they do.
Then came the answer,they would come to me and prosecute.(probably because im white,honest,and live at an address they can just come to).
I was told it cost thousands of pounds to get barristers and there isnt enough money in the government pot to fund it unless it was a concrete case.Also i will have to persue it myself if i want to claim my money back through my own solicitors etc and the information they have collected to form the case i cannot have for my own use to help my claim.
So enough said for now until i meet with TS this week for the final decision on release of paperwork.
Is there anybody using this forum who has encountered this sort of lame performance from courts T/S etc turning a blind eye to crime,deception and forgery when all they need for a conviction is staring them in the face,or even how do i go higher than TS as im now keener than ever to stop these little t***s getting away with it.

Not sure i understand your meaning of the reply.
I said sensible answers for this reason.
They can come straight to me as i live and only give 1 address.Why shouldnt i??
If we could cheat benifits not pay VAT,TAX and commit crimes because we declare we live at one of 6 brothers houses and cant be found im sure more people would do it.
At the end of the day were all entitled to justice and im not getting any.

No offence but you can have so easily prevented all of this by taking 5 mins and looking on about a dozen websites before buying the car and seeing what you should look out for. As for pursuing it, if TS aren't going to as they know they don't have enough evidence to prosecute how do you think you are going to succeed where they failed? You complain about your finances being tight but i'm sure TS have a lot more cash to splash than yourself and they see it as fruitless. Even if you do win by some slim chance I would bet everything I own you won't see a penny, you will end having to take them back to court, which again will add more costs. If they are foreign like you said whats to stop them just leaving the country??
You have also mentioned twice now about selling the car and not declaring the true mileage, should you do this then you are no better them. I know its a kick in the teeth to loose so much money but really you haven't lost anything at the moment, your only going to loose some money when you come to sell the car. If your finances are so dire that you needed your partner to get a job aswell then as long as the car is reliable just run it until it will run no more, get your full moneys worth out it, then sell it on honestly or scrap it. Time to just move on, lifes to short and you should only put your time and energy into battles you know you can win, sorry but this isn't one them.Everyones opinion is the most important.....no wonder nothing is ever agreed on.0 -

Well let me put it in more simple terms for you. You have come here to look for advise on how to sell a car that you know to be have been clocked and are complaining that you have been told, quite rightly, by Trading standards that of you sell in such a way that they will prosecute you. But to add to that you are bemoaning that they will do so on the the basis that you are, "white,honest,and live at an address they can just come to." I understand what your saying and money is tight.The car still runs and has not let us down yet.Just to clarify the car was HPI'd twice,once by me and once by TS,all came back clear due to the short time the car was turned around.
As for letting it go i know this is the easy way out and most people will end up going down this road,but ill go down it kicking and screaming.Tommorrow morning they will go to the auction buy another car knock 100k off it and sell it on.2 weeks later you hear a friend of yours bought this car and had a serious accident due to something that should of been apparent of a car with that mileage but over looked due to its lower mileage.
Any normal person would be looking for some sort of legal help and if you were asked about this would you say "id get them done if i was you".This could happen as they are only concerned in making money and nobody wants to try and stop them.0 -

Several posters have now said let it go, it's not worth the effort. We all know it's unfair and they'll do it again blah blah blah.
It's happened before and it will happen again, you can't change the world.

The reason i was told by TS they will not be persuing it is because off the extra effort needed to actually get him and they can not get the funds to get the prosecution.
At the end of the day he is giving them the run around they would not get from 90% of people living legitimally and unfortunatly i bet alot of the other 10% are foreigners who know they can get away with it because their hard to trace.
If enough effort was put into it they could and would get him as he has commited a crime and forged legal documents and will keep doing ot until people stand up to him with legal backing and stop this sort of thing.0 -
Your sentiment is honourable but you can't protect every idiot out there who doesn't take the time to check the paperwork. A HPI check only checks if there is any accident damage recorded or outstanding finance, it doesn't tell you the car has been clocked or if the cambelt is due to be changed. It seems you went to see a car the HPI was clear so it must be a good buy. The clues were there right in front of you, first being the V5 not in his name (claiming not to be a trader), secondly the lack of receipts for major work. You have made a mistake but you have a car that has been reliable and hasn't cost you any real money so far. You could have bought a genuine 65k car for 3 grand that could have been a money pit.
I'm not saying its right what they have done but you can't be complaining about how tight your money is then your willing to spend everything you have to fight this crusade that TS with a whole legal team at their disposal can't win. At the end of the day its your money, if you take them to court the most your going to get is compensation, which is unlikely to get paid. You won't get these guys put away or even stop them from continuing. There may even be information that TS are holding back from you, which maybe the reason they aren't pursuing right now, they just might be the smaller fisher in a larger pond so to speak. just because action doesn't seem to be happening right now doesn't mean its all stopped investigation wise.Everyones opinion is the most important.....no wonder nothing is ever agreed on.0 -

In all likelyhood the guy isn't even in the country anymore, hence why they aren't pursuing it. What do you expect them to do, go and trawl the middle east with a picture of the guy and drag him back to the UK.Everyones opinion is the most important.....no wonder nothing is ever agreed on.0
