    carl,

    1. Get the cambelt changed ASAP to avoid a big bill if it snaps.
    2. If the car is a goodun don't worry about the miles - mechanical and physical condition is so much more important.
    3. Magistrates and Judges have the power to award compensation to the victims of crime if they so wish. It isn't guaranteed though and you may never see the monies awarded. Ask TS to suggest that the person presenting the case in court makes an argument for any loss - i.e. the difference between price you paid and calculated value.

I can only say what I would do in this situation and the local TS taking action will make their own decision. Legislation often prohibits TS from disclosing information obtained using powers however there are a few exceptions. My authority takes the view that if a consumer is taking civil action themselves through the County Court, and we are satisfied that they are likely to do so, then we will help where we can and disclosure of pertinent information/evidence will take place, particularly when a criminal case has been heard.

A civil claim will start in the county court which will be able to assist with useful small claims leaflets. A solicitor isn't required and costs are not usually paid by the other party if you win. You will have to find out the persons true identity and address for service of documents. Proper service can be by post to the persons business address or last place of residence. I'm not up on this process but the county court will help.

However, even if you are awarded compensation by the court, you still have to get the money and may have to employ bailiffs to do so, assuming the person has assets.

    Good luck

No he did not, he paid for a car with x amount of miles on, he got something quite different.

    Basically, he was robbed.

    Thanks Hotspur,
This is the sort of information im looking for.
As the weeks tick by leading up to court (if it ever gets there)i will keep popping back hear to keep people informed of progress as im sure more people will fall victims to these scumbags, and i will probably need further answers to questions that will arise.
Thanks for all your replies so far and if anybody can help me further or have been in this situation please pm me.

This piece of legislation explains what the criminal court may do following a conviction. The section in the link relates to compensation.
