leaving due to sickness

    there is me and my disabled daughter im having to fight a tribuneral to have hers reinstated

    i bit the bullet on the dla part last week and filled in a form as i see others in there mobility car an can walk round the supermarket, this i can not do sometimes not even drive so i thought i would give it a go you never know plus that programme on bbc1 saints and sinners made me think i should maybe be entitled to something

    I can drive and none of my limbs work properly and my legs not at all, no its not a motability car either, am I a saint or sinner?

    You dont know if these people are saint or sinners and your should concentrate on your own health unless you are privey to their medical records.

    I noticed your user name and I was going to ask after your daughter, I remember the threads at the time and they show just how little you understand about disability benefits both then and now.

    I wish you well with your claim but if you dont supply proper evidence you dont really have much hope, have you asked your GP for a report and all of your specialists?

    but i know that what they have allready proposed will notwork
    i did tell them this but they say to try it out, to which they are right, they did a workplace assesment with out me being there so are going of what my colleuges said, when i questioned this they told me that what they are actually doing is for the benifit of us all which it is but there is one thing that will be a masive issue and i dont see a way arround it at all, not to mention a few others they have not addressed but can maybe be resolved

    The people at your workplace made a workplace assessment without you being there?? That doesn't make much sense to me as only you would be able to say whether it would work or not. However, let them go ahead and do try it, but only if you are fit for work - if are not fit for work see your GP before your back to work date.

    Whatever you do, do not resign! I had to leave work in the end, I tried to carry on as long as I could and fairplay my employer was very accomodating, but unfortunately I had to leave on health grounds - but only when my employer ended my contract.

    You must let your employer tell you that they have to let you go - if they wish. Otherwise if you are not fit for work carry on sick leave. Do not feel pressured by your employer.

    As for DLA, you can apply for this regardless of being employed or not. I was on DLA before I left employment. If you are applying for DLA or expecting a report from your osteopath do go and speak to your GP - it does help if your GP knows your situation as the DLA may very well contact your GP.

    i was actually meaning if they are entitled then maybe i am
    i as well as lots of others come on here to try to understand benifits and i understand my an my DD disability, but having a disability does not automaticly mean you are entitled to exra financial help i know you need to show that you have care and mobility needs which have been proven for my DD and the doctor will reply to dla to say i also do

    please do not try to belittle me because i am not savvy on all disabilities i am here to ask advice

    reports from the people i have seen cost money and it is not money i have but i know if and when they recieve a letter from the dla they will fill it in saying what i have

    saints and sinners is a tv programme i was not refering to any one else

    only you know what you are capeable of so thats a question you have to answer your self

    the work assesment is strange i know even when i tried to advise on what i thought might work he was quite abrupt on the phone

    hopefully i may get a little help from dla or somewhere else and i will give it a go, at least then i can say i tried

    i see my doctor every week or so as i have other medical conditions and were playing about with medication at the minute so he is well up to date on my pain he has been very helpfull, i like my doctor i found a good one:)

    i will ask for a report tommorrow i wanted one for the doctor anyway he wants to see if they throw light on anything new

    i do one is my friend, and others brag an tell how to act once in an atos medical

    but im not here to turn this thread in to an agrument if people play the system then let them they will be caught one day and as selfish as it sounds i am only worried about me and my DD not any one else

    please people we can all see the OP is having difficulties, lets not mis interprate things and cause the OP' thread to be locked.

    ok we've established that your in the process of claiming DLA.

    what we need to concentrate on is work.

    OP, have your employer refured you to the company doctor? (if they have one).

    occupational therepy can also help assess work and help your employer adapt your working surroundings, assess you for working capabilities.

    if you feel you can no longer work then explain this with your consultant or specialist who may write to your employer a letter reccomending that work is to cease, it will be down to your employer to decide whether to release you from contract of employment.

    you need to see your GP asap and tell him as to what you have told us, let him decide if your ready to go back.

    get all your medical reports, hospital admissions, sent off to DLA, this helps build a bigger picture for them about how the condition affects you, BUT I DO STRESS ITS NOT THE DIAGNOSIS ITS THE CARe AND MOBILITY as you have said, after the GP has filled in your report, (who may need filling in on your home care and mobility seeing it a new GP? i maybe confused with another threat i too am suffering pain ATM and cant really concentrate) the DLA may send an atos medical assessor to your property get everything ready he wont have read everything in your claim there aint enough time in the day to do go through everyones claim forms he has to keep a atos practace and do home visits. so copies of all meds prescriptions should be at hand and all med report documents youve sent off.

    fraud in DLA is minimal, so people telling you how they passed a medical, doesnt mean they got the award! i bet they dont tell you they failed it, and never challenged it at a tribunal for fear of getting found out.

    if your voluntarily leave employment you will be sanctioned by the JCP.

    if your consultant and employer agree that work isnt the best place for you right now and he releases (your employer that is) from employment the you can claim ESA right away.
