hi all
if someone leaves work due to illness are they entitled to claim any benifits
i now work have a duty of care ect but what the person still finds the job to much

Your second sentence does not make much sense, but if someone leaves due to verifiable illness (i.e. the GP agrees it would be beneficial to leave) they can claim either ESA or JSA. A JSA claim should not be sanctioned if medical evidence is supplied to confirm that the job was not practicable.Gone ... or have I?0

sorry what i ment was that if a problem is reported in the work place i know that they have a duty of care to you to help try and resolve it by way of adaptions or aids
so if my doctoct said thaqt my working at present was not good for me an wrote a fit note advising such the benifit people would allow me to claim something strait away?
the problem is i have been off work for some time due to go back on 6th feb if i carry on the way i am i can not see this happening even with the adaptions work will make which are not many due to restictions of the work place, the only answer would be a total revamp costing maybe thousands and i cant see them doing that
i know they would not sign me off them selfs and plus it would take many many months for them to do it even if they did
i cant afford to live basically
the worry and stress makes me worse and i know if i left i would be entitled to help with housing ect....
this is upseting to write as i love working and i don not want to be seen as a scrounger0 -
Would you be claiming ESA or JSA? If ESA, you won't have a problem if you have a fit note (stating that you are not fit!). If JSA, your claim will go to a Decision Maker but I can't see them denying your claim.Gone ... or have I?0

i do not actually know the difference between ESA and JSA
i have another appointment with a specialist tommorrow and some blood test to rule things out i will have to make a descision on the outcome of the tests

ESA is if you are not fit for work.
JSA is if you will be looking for new work straightaway.Gone ... or have I?0 -

Hi when will it end, as I understand it you are on sick and due to go back on 6th feb, however you don't think you will manage to go back to work even if your employer make changes/adaptions - is this correct?
If you are still unwell at the time you have to return to work then you should go back to your doctor. Even if you do go back to work and find you can't cope, do not leave employment of your own accord! You say your employer won't let you go, but if you can't manage you need to get a sick note until you can. If however your employer said that they can no longer employ you then you can leave.
You need to speak with your GP in detail and if he/she says that you will not be able to do your job, even with adaptions, then get a note stating this to give to your employer. It is then up to your employer to make the next move but never resign or you may face difficulties with benefits.
You say your employer will never be able to make certain adaptions because of cost - have they told you this or are you speculating?0 -
As they say above if you are unable to work due to sickness you can claim ESA. However, if you are classed as leaving your job voluntarily & want to look for work you have to have good reasons for leaving or you may not get JSA.
How long have you been working? My husband has lost his job today because of his 'attendance' (sick days) but because of his length of service & the fact he's not leaving voluntarily he gets paid notice & will get some compensation. Would this apply to you?

Hi, when my husband first became ill we waited until his SSP ran out and applied for ESA, (I was still working then but I had to go part time so I could care for him) and we still qualified for ESA income related. His employer finished him on health grounds about a year later.
He was told at the time not to leave voluntary but to wait for the company to make their move first. Good luck with whatever you decide.0 -
